HomeMy WebLinkAboutMINUTES - 09092014 - C.143RECOMMENDATION(S):
APPROVE and AUTHORIZE the County Probation Officer, or designee, to execute a contract with the State of
California, Franchise Tax Board (FTB), including modified indemnification language, for the collection of unpaid,
court-ordered fees via tax intercept, for the period October 1, 2014 through September 30, 2017.
FISCAL IMPACT:
Actual cost to the Probation Department will not exceed 15% of debt collected by the Franchise Tax Board,
approximately $32,000 annually.
BACKGROUND:
The Probation Collections Unit (PCU) collects debt owing for parental responsibility for the care of youth in Juvenile
Hall and Orin Allen Youth Rehabilitation Facility, Juvenile Electronic Monitoring fees and Adult Public Defender
fees. Once the PCU has exhausted their means of collecting on an account, the outstanding debt is referred to the
State of California Franchise Tax Board (FTB) for collection via tax intercept. During fiscal year 2013/14,
approximately 28% of collections were from the FTB.
CONSEQUENCE OF NEGATIVE ACTION:
Probation collections would be reduced without an agreement with the FTB.
