HomeMy WebLinkAboutMINUTES - 09092014 - C.16RECOMMENDATION(S): ADOPT Resolution No. 2014/319 approving the second extension of the Subdivision Agreement (Right-of-Way Landscaping) for subdivision SD08-09246, for a project being developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corporation, as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District II) FISCAL IMPACT: No fiscal impact. BACKGROUND: The Subdivision Agreement needs to be renewed as the improvements are not completed. (Approximately 15% of the work has been completed to date.) The developer has requested additional time to complete improvements. Granting an extension gives the developer an additional year to complete the improvements and keeps the bonding current. CONSEQUENCE OF NEGATIVE ACTION: The Subdivision Agreement will not be renewed if the extension is not granted; the developer cannot complete the improvements; the bonds cannot be kept current; and, the County may need to take legal action to complete the improvements, or revert the property to acreage.
