Subject:Waiver of 180 Day "Sit Out" Period for Temporary Hire of Fire District Retiree
FISCAL IMPACT:
Salary and benefits costs for this position are included in the Fire District’s 2014-15 operating budget. However, only
temporary salary costs and the associated roll-ups are required for a temporary appointment (i.e., there are no
benefits costs), which will result in a cost savings until a qualified permanent replacement can be found.
BACKGROUND:
The Public Employees’ Pension Reform Act of 2013 (Act) requires that active members who retire on or after
January 1, 2013, must wait 180 days after retirement before returning to work as a temporary employee. The Act
allows the Board of Supervisors acting in its capacity as Fire Board of Directors, based on a finding that the
appointment is necessary to fill a critically needed position, to waive the 180 day "sit out" period. Contra Costa
County Fire Protection District is requesting an exemption from the 180 day sit out period for Ronald Guelden, Fire
District Facilities Manager.
Mr. Guelden is the sole employee in the District’s facilities management division. He is responsible for the
construction, maintenance, repair, acquisition, and disposition of all District facilities and properties. This includes 28
active and closed fire stations, the District administration office, the training and EMS campus, the supply warehouse,
the apparatus shop, satellite offices, and vacant properties.
The District will conduct an aggressive recruitment to fill this vacancy. A request has already been submitted to the
County Human Resources Department to begin the process of filling this critical position. In addition to the time
needed for the recruitment, testing, and hiring phases, time is needed for training and the transition of a qualified
replacement for Mr. Guelden.
The skills required for this position are highly specialized and require a detailed understanding of District operations.
With over 30 years of experience in facilities management, construction, and public sector work, Mr. Guelden is
uniquely qualified to perform the critical tasks associated with this position. The District does not have any other staff
that possesses the specialized, technical and business knowledge for this position.
The loss of Mr. Guelden from the Fire District Facilities Manager position will severely impact the ability of the
District to maintain and preserve the facility assets and to provide support services to District operations. As such, the
District requests the temporary appointment of Mr. Guelden as Fire District Facilities Manager to allow for suitable
time to recruit, test, appoint, and transition a new hire.
CONSEQUENCE OF NEGATIVE ACTION:
Significant negative impact in the District’s ability to manage, maintain, and repair District facilities and properties.
