FIND that the appointment of Mr. Van Horn is necessary to fill a critically needed position. 3. APPROVE and AUTHORIZE the hiring of retiree Steven Van Horn as a temporary County employee for the period of August 13, 2014 through July 31, 2015, as recommended by the Public Works Director. FISCAL IMPACT: Salary costs are included in the Department’s operating budget. There will be salary and employment tax payments for the hours provided of approximately $45,470.00, for up to 900 hours, not to exceed a twelve (12) month time period. These costs will be offset by savings due to the vacancy of the permanent position. Bueren, Public Works Director/Chief Engineer Date:August 12, 2014 Contra Costa County Subject:Temporary Hire of County Retiree - Waiver of 180 day "sit out" period BACKGROUND: The Public Employee Pension Reform Act of 2013 requires that active members who retire on or after January 1, 2013 must wait 180 days after retirement before returning to work as a temporary employee. The Act also allows the Board, based on a finding that the appointment is necessary to fill a critically needed position, to waive the 180 day “sit out” period. Mr. Steven Van Horn retired from the Public Works Department effective July 11, 2014 after holding the position of Senior Real Property Agent within the Real Estate Division since 1999. Mr. Van Horn started with the County in 1990 as a Jr. Real Property Agent and has provided great customer service to the County over the last 24 years. He works with other County departments, as well as outside groups and agencies completing lease agreements and real estate transactions on behalf of the County. Given the recent departure of many staff members from the Real Estate Division, our Department has begun a recruitment effort to properly staff the division. However, Mr. Van Horn’s knowledge and expertise in real estate is necessary to keep the level of service acceptable and provide much needed staffing during this time. The Department will continue to work with Human Resources to complete the recruitment effort. We would anticipate requiring Mr. Van Horn’s services through this period and also to assist in transition once the recruitment effort is complete and permanent full-time staff has been hired. Given the number of leases, pending projects and foreseeable workload, it is critical that the Department have Mr. Van Horn during this time. CONSEQUENCE OF NEGATIVE ACTION: Failure to receive Board approval will result in a significant negative impact in the department’s ability to provide necessary critical services.
