APPROVE and AUTHORIZE the Department of Conservation and Development Interim Director, or his designee,
to execute a contract with Environmental Science Associates (ESA) in an amount not to exceed $392,874 for the
preparation of a Recirculated Environmental Impact Report (EIR) for the Phillips 66 Propane and additional Butane
Recovery Project in the Rodeo area, for the period of August 13, 2014 through April 13, 2015.
FISCAL IMPACT:
No impact to the general fund. The cost for preparing the Recirculated EIR is charged to the project applicant.
BACKGROUND:
The Department of Conservation and Development received an application from Phillips 66 requesting approval of a
land use permit to process the Propane and Additional Butane Recovery Project at its refinery in Rodeo. An EIR was
prepared for the project and was certified by the County Planning Commission on November 19, 2013 and the
decision was subsequently appealed to the Board of Supervisors. On January 14, 2014, staff received a letter from the
Bay Area Air Quality Management District (BAAQMD) requesting further data and expanded air quality and health
risk analysis be included in the EIR. On January 21, 2014, the Board received testimony from the appellants,
applicants, and the general public. Upon conclusion of public testimony and deliberation of the Board, the matter was
continued in order for the Department of Conservation and Development to respond to the BAAQMD letter.

BACKGROUND: (CONT'D)
Following detailed consideration of the issues raised in the BAAQMD letter, the Board directed on June 3, 2014, that
the EIR be recirculated. To revise and recirculate the EIR as directed, analytical and technical work is required to
revise the prior document. DCD staff will be working with ESA to revise the previously prepared EIR. This revised
EIR will be recirculated as directed by the Board.
CONSEQUENCE OF NEGATIVE ACTION:
The Department will be unable to complete the recirculation of the EIR for the pending land use application.
CHILDREN'S IMPACT STATEMENT:
This request is for authorization and approval to execute a contract with Environmental Science Associates (ESA), no
impacts are associated.
