ADOPT Position Adjustment Resolution No. 21494 to add one (1) Supervising Real Property Agent (DYNA)
(represented) position at salary plan and grade ZA5 1822 ($6,563 - $7,978), cancel one (1) vacant Real Estate
Manager – Exempt (DYD1) (unrepresented) position #1804 at salary plan and grade B85 1871 ($6,892 - $8,378), and
abolish the Real Estate Manager – Exempt (DYD1) classification in the Public Works Department.
FISCAL IMPACT:
The cancellation of the Real Estate Manager – Exempt (DYD1) position results in savings of $180,648, which will
offset the $131,446 cost associated with adding a Supervising Real Property Agent. Overall, this action will result in
a net savings of approximately $49,200 annually.
BACKGROUND:
In 2012, the General Services and Public Works Departments merged, bringing together two departments with
different organizational structures. At that time, it was agreed that previous General Services divisions would be
altered to match the Public Works divisions. This greatly impacted the Real Estate divisions previously

Subject:Add a Supervising Real Property Agent, cancel a vacant Real Estate Manager-Exempt position and abolish the Real
Estate Manager-Exempt classification
BACKGROUND: (CONT'D)
located in both departments since there were two Division Managers – the Principal Real Property Agent
(represented) and the Real Estate Manager (exempt). During the merge, the Real Estate division was organized so
that the Principal Real Property Agent would remain as Division Manager over the newly formed group and the
Real Estate Manager – Exempt would act as a Supervisor, similar to the Supervising Real Property Agents already
in place, and report to the Principal Real Property Agent which caused some issues. The exempt position no
longer met the requirements to be an exempt classification since it reported to a Division Manager who was
represented. Additionally, the Real Estate Manager was performing equivalent duties to the Supervising Real
Property Agents, but being compensated at a higher rate and different benefits. These issues could not be
addressed previously, because the Real Estate Manager – Exempt position was not vacant. However, since the
previous incumbent retired as of July 11, 2014, the department would like to move forward with implementing
these changes.
CONSEQUENCE OF NEGATIVE ACTION:
If this action is not adopted, the Real Estate Manager – Exempt position would be compensated at a higher rate
for performing the same duties as the other Supervising Real Property Agents. Additionally, the Real Estate
Manager – Exempt position would be the only position in the division to have “exempt” status, without meeting
the requirements to be an “exempt” classification.
