BACKGROUND:
Prior to 2008, the Board of Supervisors had a standing referral to the Internal Operations Committee for providing
updates on the implementation of the Board’s policy on the use of PLAs in County capital projects. At a November 3,
2008 Internal Operations Committee meeting, the referral was suspended. In 2009, the President of the United States
signed an executive order to allow PLAs on federally funded projects, reversing the previous executive order
prohibiting the use of PLAs on federally funded projects. Because of this change, the Public Works Department

Subject:Update on County’s Experience with the Project Labor Agreements
BACKGROUND: (CONT'D)
began experiencing difficulty in getting federal approval for the use of PLAs on federally funded transportation
projects. No other projects were affected by the change in federal policy. Because of this change, staff brought the
issue back to the Internal Operations Committee to discuss and request direction from the Committee on how to
proceed on implementing the policy. Since 2009, the issue of implementing PLAs on federally funded
transportation projects has been discussed at several Internal Operations Committee meetings. At the April 7,
2014 Internal Operations Committee meeting, Public Works staff presented additional information on the
progress made in resolving the issue of approval of the County’s Project Labor Agreements by federal agencies.
The difficulty in implementing the Board of Supervisor’s PLA policy was specific to federally funded
transportation projects that required Federal Highway Administration and Caltrans approval. County staff worked
with Congressman Miller’s office to address the federal government’s concern in approving PLAs on County
federally funded construction projects. Both Caltrans and the Federal Highway Administration (FHWA) need to
approve the use of PLAs on federally funded transportation projects. County staff was successful in having two
project PLAs approved that included the following projects:
• Vasco Road Safety Improvements, Phase 2, $11.0 million, uncertain construction season
• Alhambra Valley Road Safety Improvements, $1.5 million, 2015 construction season
Upon successful approval of the above two projects, the County submitted an additional three projects, listed
below, that are scheduled for construction in the 2014/2015 construction seasons.
• San Pablo Avenue Bridge Replacement, $2.7 million, 2014 construction season
• Marsh Creek Detention Facility Bridge Replacement, $1.1 million, 2014 construction season
• Orwood Road Bridge Replacement, $5.5 million, 2015 construction season
We anticipated no issues with the approval process. However, with a change in personnel at FHWA and some
confusion on the most recent PLA language approved by FHWA on the previous two projects, FHWA had
requested additional information on each of the projects. After working with FHWA staff and the Contra Costa
Building and Construction Trades Council, we were able to provide the information FHWA needed for the
approval process. We received official approval of the use of PLAs on all three projects listed above for the
2014/2015 construction season.
As we have worked through the process of obtaining approval for the use of PLAs on federally funded projects,
we have determined that the process is becoming routine and we have gained a better understanding of what
information is expected by FHWA and Caltrans for the approval process.
In addition, at the April 7, 2014 Internal Operations Committee, there was discussion as to whether PLAs resulted
in any identifiable negative impacts on the overall cost or schedule for delivery of capital projects. Staff reviewed
the readily available contract data that is generated by Public Works (attached). The three spreadsheets attached
show bid information related to infrastructure projects of all types administered by the Public Works Department.
One of the spreadsheets focuses on County building projects, and the other two spreadsheets focus on road, flood
control, and airport related projects. Staff determined that there are a significant amount of variables with each
project and therefore there is no conclusive data within the spreadsheets that would either support or not support
identifiable negative impacts on cost and schedule of projects that are PLA and non-PLA projects. For example,
the amount of bids received for each project may be related to the time of year the project is advertised, or the
type of work that the project contains, or the contract dollar amount and not necessarily if the project contains a
PLA or not. With all these variables, it is difficult to draw any conclusions as to the source for the number of
bidders received on a particular project. It is also difficult to draw any conclusions as to the initial bid amounts as
compared to the County’s cost estimate since County staff is not part of the contractor’s bid preparation process
and therefore would not know whether contractors adjust their bids to account for contracts that include PLAs.
Staff can conclude that there are some minor costs to cover staff time to prepare the PLA justification to submit to
FHWA on federal projects, however, non-federally funded PLA projects do not require this justification. The
additional cost to prepare the justification is negligible. In addition, it does take time for the contractors to execute
the PLA, but this has not had a significant impact on the overall schedule as there are other items that are more
likely to drive the schedule.
The Internal Operations Committee recommended that the item be referred to the full Board as a short discussion
item. Staff recommends that the Board accept this report, and suspend the referral for PLAs until interest arises in
further examination or amendment to the existing policy.
CONSEQUENCE OF NEGATIVE ACTION:
Staff would continue to provide updates on the use of Project Labor Agreements to the Internal Operations
Committee.

Re: Oppose: D.14 ACCEPT an update regarding efforts to address the approval process of Project
Labor Agreements (PLA); and, DETERMINE that, as PLAs have become a routine aspect of County
capital projects, the referral to the Internal Operations Committee shall be suspended until interest arises
in further examination or amendment of the existing policy, Countywide.
Dear Chairman Mitchoff:
Associated Builders and Contractors (ABC NorCal) Northern California is a non-profit construction trade
association of 500 construction and construction related firms representing 22,000 workers. Many are
located in Contra Costa County and have performed work for Contra Costa County. Our members range
from some of the largest construction companies in the Bay Area to small businesses with five or fewer
employees. Most ABC NorCal members perform commercial, industrial, and public works
construction. ABC also operates State and Federally approved apprenticeship programs in several
trades and trains 275-300 apprentices per year.
ABC supports fair and open competition and increasing opportunities for all workers regardless of their
affiliation.
Before you make any decision to limit transparency by eliminating yearly public reporting on the progress
of the Project Labor Agreement in the Internal Operations Committee, please consider the following:
The Contra Costa County Project Labor Agreement language constantly needs to be monitored. You are
requiring contractors to sign contracts with unions. Are you concerned about something that will be
revealed? This issue is not routine as your agenda item suggests. It continues to be highly controversial.
ABC is still getting numerous complaints from its contractors about having to change their business
practices in order to bid on PLA projects.
Where is your data on local hire and hiring of veterans, women and minorities and improved compliance
with State Labor Law?
Between 2002 and 2012, an internal audit by ABC NorCal found 78% of Contra Costa County bids were
awarded to companies outside Contra Costa County. Only 4% of the total companies that performed
work under the Project Labor Agreement could be identified as non-union. The Project Labor Agreement
has created a monopoly for union contractors from outside the county.
A recent audit of the Contra Costa County New West County Health Center revealed no internal labor
compliance was being done on Project Labor Agreement projects. In addition, just 9% of the total hours
worked were from West Contra Costa County residents and 28% from the remainder of the county. One
contractor, Guarantee Glass, was assessed $104,008.43 for unpaid wages and penalties under Labor
Code 1775 and 1813.
PLAs do not ensure projects are built on time and on budget. The First and Second Floor Remodel and
Parking Lot Expansion at 1650 Cavallo Road, Antioch for the Contra Costa County Employment and
Human Services Department built under a Project Labor Agreement was completed 385 days late and
$350,000 over budget. The project experienced numerous delays, excessive change orders and
liquidated damages. The General Contractor was found in breach of contract for failure to pay bills for
labor and materials on the project. As a result, over 26 stop notices totaling more than $1.7M were filed
on the project. Two subcontractors filed lawsuits. Many subcontractors and suppliers slowed or cut off
the supply of labor and materials to the project, causing the work on the project to progress erratically and
at a slow pace.
In your August 5, 2003 staff report, you refer to Project Labor Agreements in conjunction with certain
large, complex County construction projects involving numerous contractors and employees in different
trades, having critical timelines for completion, and requiring a skilled and properly trained workforce to
successfully complete the work properly and timely. Project examples include reservoir, wastewater, and
other large, complex construction projects.
In addition, when this issue is taken out of the hands of elected officials and placed before the electorate,
the electorate overwhelmingly supports Fair and Open Competition. Recent examples where Fair and
Open Competition prevailed by voters include: San Diego County 76%, Oceanside 54%, Chula Vista
56%, and the City of San Diego Prop A 58%. Nationwide, 21 states have banned the use of PLAs.
For these reasons, we urge you to reject D. 14, increase your threshold up to $20M to only cover complex
projects and take-up your existing Project Labor Agreement policy in your next Internal Operations
Committee meeting and look for solutions that will include the Contra Costa County workforce and benefit
the community in its entirety. Please include our opposition in your 7/29/14 minutes.
