FIND that the appointment of Mr. Roche is necessary to fill a critically needed position; 3. APPROVE and AUTHORIZE the hiring of county retiree Patrick Roche as a temporary County employee for the period August 1, 2014 through March 31, 2015. FISCAL IMPACT: There will be no impact to the County General Fund. Salary costs will be approximately $50,296 for up to 960 hours, not to exceed the seven month period, all costs are within the Department's operating budget. These costs will be offset be savings due to the vacancy of the permanent position, resulting in a cost savings of $43,575. BACKGROUND: The Public Employee Pension Reform Act of 2013 requires that active members who retire on or after January 1, 2013 must wait 180 days after retirement before returning to work as a temporary employee. The Act also allows the Board, based on a finding that the appointment is necessary to fill a critically needed position, to waive the 180 day "sit out" period. Mr. Roche was the Principal Planner in the Department’s Advance Planning Section. Among his responsibilities he was co-leading the preparation of the 2014 General Plan Housing Element Update. The 2014 Housing Element Update was authorized by the Board of Supervisors on October 15, 2013. The Housing Element update is now in-progress and it is a time sensitive priority for the Department with a statutory deadline for completion by January 31, 2015. In order to ensure the timely completion of the 2014 Housing Element Update by the statutory deadline, Mr. Roche is proposed to be retained as a temporary County employee to oversee the preparation of the Housing Element Update, and related updates to the Land Use, Safety, and Growth Management elements of the General Plan pursuant to State law that are triggered by the Housing Element update, from August 1, 2014 to February 1, 2015. During this period, Mr. Roche will be responsible for the following projects associated with the 2014 Housing Element Update: 1. Continued management of the 2014 Housing Element Update, co-managed with the Department’s Affordable Housing Programs Manager, including document editing, coordination with the California Department of Housing and Community Development to secure certification of compliance with State law, environmental review under the California Environmental Quality Act (CEQA), public outreach, reports and presentations to the County Planning Commission and Board of Supervisors. 2. Preparation of necessary amendments to the Land Use and Safety elements, which are triggered by the Housing Element update, pursuant to State laws. Specifically, the 2014 Housing Element Update triggers the following focused updates to other General Plan elements: • Assembly Bill 162/Senate Bill 5 – These laws require that when the Housing Element is updated the flood hazard map and policies contained in the Safety Element shall be updated to reflect 200-year flood event hazards, instead of 100-year flood event. • Senate Bill 1241 – This law requires that when the Housing Element is updated the fire hazard map and policies in the Safety Element shall be updated to show the latest State Responsibility Area (SRA) and Very High Fire Hazard Severity Areas as determined by the California Department of Forestry and Fire Protection. • Senate Bill 244 - This law requires that on or before adoption of the Housing Element update, there shall be a review and update to the Land Use Element to identify disadvantaged unincorporated communities (island, fringe, or legacy unincorporated communities where the median household income falls below 80% of the state median household income) and provide an analysis of water, wastewater, storm-water drainage, and structural fire protection needs or deficiencies for each identified community, and provide an analysis of potential funding mechanisms to feasibly extend services and facilities to identified communities. 3. Preparation of a minor amendment to the Growth Management Element concurrent the Housing Element Update pursuant to obligations under the Contra Costa Transportation Authority’s approval in 2012 of the County’s Growth Management Program (GMP) Compliance Checklist for Calendar Years 2010 and 2012. Though a key focus for Mr. Roche during this period will be the Housing Element Update, he will also continue other duties associated with Advance Planning, train a successor and transfer knowledge gained from more than 24 years with the Department. With Mr. Roche's retirement, the Department is taking the necessary steps to identify a suitable staff to fill the vacancy. The Department expects the hiring to fill this vacancy and the subsequent training to take approximately six months, which allows for a reasonable transition period. CONSEQUENCE OF NEGATIVE ACTION: As noted above, the 2014 Housing Element Update and related updates to the Land Use, Safety, and Growth As noted above, the 2014 Housing Element Update and related updates to the Land Use, Safety, and Growth Management elements are departmental priorities previously authorized by the Board of Supervisors. Failure to receive approval of this request will jeopardize the timely completion of the Housing Element Update. CHILDREN'S IMPACT STATEMENT: None.
