SD.4 HEARING to consider adoption of Resolution of Necessity No. 2014/12 for acquisition by eminent domain of real
property required for the I-80/San Pablo Dam Road Interchange Improvement Project – Phase 1, San Pablo area.

Speakers: Herstus-McGinley, property owner of 5303 Riverside in San Pablo, informed the Board that they did
not consider the offer made for the property on which they built their retirement home was adequate.
Supervisor Gioia briefly outlined the process for the couple, noting they had the right to seek legal counsel.
Supervisor asked the members of the Contra Costa Transportation Authority in today's audience to convey the
concerns noted today to their office.

DELIBERATION ITEMS
D.1 CONSIDER accepting report and findings from the survey of municipal advisory committees regarding the addition
of an alternate seat(s) to 7-member MACs and an option to add a non-voting youth seat to any MAC, regardless of
composition. (David Twa, County Administrator)
The County Administrator, Mr. David Twa, noted that a suitable release form is already available and
Recommendation No. 5 is removed from consideration.
ACCEPTED the report and findings from the survey of municipal advisory committees; FOUND also that
quorum requirement is statistically, nearly the same for both 5 and 7 member bodies (at 60% and 57%,
respectively); MODIFIED the MAC Policy to permit up to one alternate seat for each MAC, which can be
recruited and filled upon Board approval at the discretion of the corresponding District Supervisor;
MODIFIED the MAC Policy to permit the addition of one non-voting youth representative seat to each MAC,
which can be recruited and filled upon Board approval at the discretion of the corresponding District
Supervisor.

D.2 CONSIDER accepting year-end reports on the County’s 2013 Federal and State legislative programs, adopting the
2014 Federal and State Legislative Platforms, and providing further direction to County staff regarding legislative
advocacy efforts, as recommended by the Legislation Committee.
Speakers: Rollie Katz, Public Employees' Union Local One,encouraged support for legislation to lower the the 2/3
threshold required for increasing local and property taxes to 55% and suggested examining the possibility of reviewing the frequency of
how often commercial properties are reassessed; Alex Alifaris, resident of Contra Costa, urged the Board to rethink its position on the
2/3 threshold, anticipating that tax increases would further discourage business and property owners from doing business in California.
ADOPTED the recommendations as presented; and REFERRED the matter of reexamination of assessment practices for commercial
properties to the Legislation Committee.
