BRAGDON, DIRECTOR OF COMMUNITY DEVELOPMENT Com" "1 v DATE: SEPTEMBER 29, 1986 SUBJECT: PROPOSED FEE INCREASE FOR THE COMMUNITY DEVELOPMENT DEPARTMENT SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) A BACKGROUND AND JUSTIFICATION RECOMMENDATION: Accept request/report from the Community Development Department and set a hearing date of October . 28, 1986 to receive any public comments on the proposed Community Development Department Fee Schedule. FINANCIAL IMPACT: The fee increase is requested to lessen dependence on funds from the County General Fund. REASONS FOR RECOMMENDATION: The current fee schedule became effective in January, 1985 and since that time, the Community Development Department was established by the Board. Costs increased substan- tially for the following reasons: (1) Engineers were assigned to the Department without sufficient off-setting revenues to cover costs; (2) a cost of living was granted effective July 1, 1985; (3) a second cost of living was effective July 1, 1986; (4) the scope of work for the Department has increased for the Current and Advanced Planning Divisions due to the additional number of advisory bodies and the additional infrastructure considerations; and (5) to increase the revenue to cost ratio to ' lessen dependence on County General Funds. BACKGROUND/INFORMATION: It is estimated that the revenue to cost ratio is approximately 55 percent of cost. By proposing a single fee for the unincorporated area of the County, we estimate that the proposed schedule would increase revenue by approximately 35 to 45 percent, the majority of which will be in the industrial ,- office and commercial areas if the number and mix of applications is approximately the same as it has been during FY 85-86. In accordance with Government Code, a hearing is required allowing the public 10 days to review this request. IMPACT OF NEGATIVE ACTION: Fees will remain at their present level and additional revenues to cover added costs will not be realized. Environmental Impact Reports prepared by County staff shall be charged at cost against money deposited in advance by the applicant. Environmental Impact Reports prepared by consultants engaged by the County will be charged against money deposit in advance by the applicant and shall include an additional non-refundable twenty-five percent (25%) of the consultant's fee for Community Development Department costs in support thereof. If the costs exceed the applicant's deposit, the applicant shall upon initial hearing on the proposed action pay the excess costs to the County; if the consultant costs are less than the deposit any excess shall be refunded to the applicant. The Director of Community Development may waive part or all of the fee for planned unit district final development plan EIR if he finds that the preliminary development plan EIR was sufficiently comprehensive to cover final development plan consideration. (Ord. 74-2 3) (b) Rezoning Fee. The highest filing fee specified in the attached schedule for any . rezoning application shall be charged. (c) Refunds. If an application, filing, or appeal is withdrawn before any required notice is mailed but after work has begun, the Director of Community Development may authorize .a partial or complete refund of required fees in proportion to work of costs incurred. Once required notice is given, no refund may be granted. (d) Late Filing. Wherever the Director determined that: (1) A person has begun illegal construction of land use without first applying for and obtaining Community Development Department permits required therefore he shall apply as soon as practicable and pay a fee of one and one-half (1 1/2) times the normal fee. In the case above, the person remains subject to other- penalties and enforcement procedures of the Ordinance Code. (e) Bond Processing Fee. Whenever an applicant elects to post a faithful performance bond in lieu of improvements required in conditions of approval , he shall pay an additional non-refundable five percent (5%) of estimated improvement costs in cash, check or money order (but not less than $100 nor more than $500) for administrative costs in connection with bond processing. (f) Special Services. The Community Development Department shall charge requestors of special services, including but not limited to Geologic Hazards (Alquist/Priolo) Act report reviews and research and/or compilation of data, at the rate of $40/hour. (g) Fees for Public Service Activities. The Director may waive the fees required by this resolution for applications (Action Proposed) filed by community interest, non-profit groups receiving substantial support from public funds for proposed public service activities. (h) Building Permit Process Fee. The Community Development Department shall charge for those services rendered subsequent to approval of planning entitlement and through occupancy, in order •to ensure compliance with all the conditions of project approval . The fee will be $10 per permit or 10% of the building permit fees, which ever is greater. The fee will be collected by the Building Inspection Department at the time of collection of other building permit fees. Rdv:vplmiscdisk
