ADOPT Resolution No. 2014/210 vacating portions of Contra Costa County Flood Control and Water Conservation
District (District) easements along San Ramon Creek encumbering Quail Court, pursuant to Section 31 of the Flood
Control Act, and issue a Quitclaim Deed pursuant to Government Code Section 25526.5. Project No.: 0676-6Q1809
(CP#14-10)
DETERMINE that this activity is not subject to the California Environmental Quality Act (CEQA) pursuant to
Article 5, Section 15061 (b)(3) of the CEQA guidelines. DIRECT the Director of the Department of Conservation and
Development (DCD) to file a Notice of Exemption with the County Clerk, and DIRECT the Public Works Director,
or designee, to arrange for payment of the $50 fee to the County Clerk for filing and a $25 fee to the DCD for
processing of the Notice of Exemption.
AUTHORIZE the Chair of the Board to execute a Quitclaim Deed on behalf of the District and DIRECT the Real
Estate Division of the Public Works Department to cause said Quitclaim Deed to be delivered to the grantee for
recording in the office of the County Recorder.

Subject:ADOPT Resolution No. 2014/210 to vacate and quitclaim portions of Flood Control Easements and APPROVE
related actions under CEQA, Walnut Creek area.
FISCAL IMPACT:
100% Applicant Fees.
BACKGROUND:
Caltrans previously constructed a channel for a segment of San Ramon Creek, just north and south of Creekside
Drive Bridge, in the City of Walnut Creek to provide flood control protection. In 1961, Caltrans quitclaimed and
granted easements to the Contra Costa County Flood Control and Water conservation District (District).
Currently, the property owner has development plans for this site which require vacating and quitclaiming of the
easements.
The District does not currently maintain this area of San Ramon Creek because the San Ramon Bypass Channel
was subsequently constructed as the primary flood control channel. The District has determined that the easements
over San Ramon Creek on the north and south sides of the Creekside Drive bridge crossing and the associated
access easements located within Quail Court are no longer needed. Therefore, the District intends to vacate any
and all rights, title, interest, obligation, and responsibility of a segment of San Ramon Creek, identified in the
document recorded on April 7, 1961 in Book 3841, Page 187 and in Book 3841, Page 194 of Contra Costa
County Official Records and in the document recorded on March 2, 1977 in Book 8224, Page 898 of Contra Costa
County Official Records.
CONSEQUENCE OF NEGATIVE ACTION:
The District may be responsible for the maintenance of an area that is no longer required for the purposes for
which it was intended.
