ACCEPT a report on the status of the Fire Station 46 project proposal and a concept for cost sharing between Contra Costa County Fire Protection District and Moraga-Orinda Fire Protection District for the construction, maintenance, operation and staffing of the fire station; and 2. DIRECT the Fire Chief to take steps necessary to formalize an agreement with Moraga-Orinda Fire Protection District for the construction, maintenance, operation, and staffing of Fire Station 46, for subsequent review and approval by the Board of Directors. FISCAL IMPACT: The fiscal impact to the Fire District would be minimal until a formalized plan is prepared and approved by the Board. This is a presentation of a cost-sharing concept and direction from the Board will determine the potential future fiscal impact of this project. The station was vacated in June 2012 due to occupational safety issues primarily dealing with mold and rodent infestation. FS 16 was later identified for closure due to budget reductions and was closed in January 2013. The Moraga-Orinda Fire Protection District (MOFD) has a station in close proximity to FS 16 -- Fire Station 43 (FS 43) in east Orinda. Both FS 16 and FS 43 have relatively low call volumes. Since FS 43 was scheduled to be relocated and FS 16 was in need of replacement, talks were initiated between MOFD and the Contra Costa County Fire Protection District regarding the potential to operate a joint fire station facility in West Lafayette to serve both jurisdictions with one crew operating from this shared facility. The concept of a shared facility would allow for cost savings in operations for both jurisdictions into the future. MOFD purchased a parcel in West Lafayette for the construction of this facility. Next Steps If the Board elects to pursue this project, next steps might include the following: A. CCCFPD and MOFD to evaluate and negotiate the following issues pertaining to the construction and operation of Station 46: Design budget.1. Construction budget. 2. Governance structure of partnership.3. Withdrawal provisions of agreement.4. Property ownership.5. Building operation and maintenance.6. Station staffing.7. B. MOFD to complete CEQA review. C. Return to Board of Supervisors for authority to enter into agreement. CONSEQUENCE OF NEGATIVE ACTION: A decision not to move forward on continued planning for this project would stop the Fire District's involvement in this project. CHILDREN'S IMPACT STATEMENT: No impact. ATTACHMENTS Station 46 Outline of Potential Deal Points Station 46 Cost Sharing Worksheet Contra Costa County Fire Protection District Fire Station 46 Proposal Outline of Potential Deal Points Land Acquisition Moraga-Orinda FPD (MOFD) purchased the parcel for $1.225 million Contra Costa County Fire Protection District (CCCFPD) paid for site geo-technical evaluation Design and Construction Initial design of facility and orientation on the parcel was completed to verify the facility could be built on the parcel and to estimate costs of construction CCCFPD to pay for the cost of construction, including architectural design, permits, site preparation, construction, mitigations, and any other design/construction related expenses (estimated at $6 million) o CCCFPD will use a combination of existing capital funds and a financing program for the remainder portion of the construction. $2.5 million up front $3.5 million + interest; financed at $500,000 per year for 7 years (2014-2021) Operation and Maintenance MOFD pays 100% operational costs once station is opened in FY2016/17 for a period of 5 years CCCFPD begins paying operational costs beginning in FY2021/22 o This coincides with the scheduled reduction in POB debt service of $5.7 million o Operational costs paid at a rate of more than 50% until MOFD/CCCFPD contributions for the project are equalized in FY2026/27 (estimated). o MOFD and CCCFPD pay half of all operational and maintenance costs starting in FY2026/27 (estimated). Other Project Notes and Items of Discussion o The proposed structure of this partnership is still being discussed, but a Joint Powers Agreement (JPA) administered by both agencies for the ownership, construction, operations, and maintenance appears to be a potential solution. Upon Board approval to move forward with formal negotiations and plan development, this issue will be fully vetted and considered with legal counsel from both agencies. o MOFD will provide the initial fire apparatus for FS 46 all equipment and apparatus will be owned by the JPA and all future apparatus and equipment purchases will be shared equally. o MOFD will be the operator of the facility and will provide three-person staffing of one Fire Captain, one Engineer, and on Firefighter with at least one of these positions being a paramedic. o FS 46 personnel will be employed by MOFD and will report to MOFD Fire Chief with consultation between MOFD and CCCFPD Fire Chiefs regarding operational issues. o FS 46 will cover a portion of Lafayette and Orinda as part of their first-due response area.
