ADOPT Resolution No. 2014/188 approving the Side Letter between Contra Costa County and the Contra Costa
County Defender's Association adding subsection 24.3 "Deputy Public Defender Law School Student Loan
Reimbursement Program" to the current Memorandum of Understanding (MOU) (July 1, 2011 – June 30, 2015).
FISCAL IMPACT:
Approximately $166,000 immediately following approval of the side letter. Going forward, eligible employees will
be compensated up to $9,000 each, in total, over a period of five years of County service.
BACKGROUND:
The existing Memorandum of Understanding (MOU) with the Contra Costa County Defender's Association does not
include a provision for a Law School Student Loan Program, which is currently authorized for the Contra Costa
County Deputy District Attorney's Association. The Defender's Association MOU includes a provision whereby if the
County and Deputy District Attorneys Association enter into an MOU that includes any new benefits, deletes or
modifies existing benefits, the same new benefit or deletion or modification of existing benefits shall simultaneously
apply to the Deputy Public Defenders classification series. The Side Letter being considered today will authorize a
Law School Student Loan Program for certain Deputy Public Defenders.

Student Loan Reimbursement Program"
BACKGROUND: (CONT'D)
> Specifically, the Side Letter implements the following:
1. Eligible Classifications: Employees first employed in the classifications of Deputy Public Defender I and/or
Deputy Public Defender II and in paid status as of July 1, 2014.
2. Payments: Employees meeting the eligibility requirements above may receive up to three payments, totaling
$9,000 for the purposes of reimbursement of Law School Student Loans. The payments are as follows:
a. First Payment ($2,000): Worked as a Deputy Public Defender I, II or III for at least three (3) consecutive
years from the date of hire.
b. Second Payment ($3,000): Worked as a Deputy Public Defender I, II or III for at least four (4)
consecutive years from the date of hire.
c. Third Payment ($4,000): Worked as a Deputy Public Defender I, II or III for at least five (5) consecutive
years from the date of hire.
Employees employed less than forty hours per week will receive a pro-rated reimbursement based on authorized
positions hours. In addition, employees are responsible for filing reimbursement claims on a form to be provided
by the Auditor-Controller's Office. The reimbursement may be subject to federal and state withholding.
The terms of this Side Letter will be incorporated into the next MOU between the County and the Contra Costa
County Defender's Association.
CONSEQUENCE OF NEGATIVE ACTION:
Eligible members of the Contra Costa County Defender's Association will not receive certain reimbursements for
outstanding law school student loans.
CHILDREN'S IMPACT STATEMENT:
No impact.
