AUTHORIZE a “yes” vote in favor of Community Facilities District No. 2014-1 (Railroad Avenue Specific Plan Area) one-time special tax (Special Tax) on parcels of real property owned by Contra Costa County (County), identified as Assessor’s Parcel Numbers (APN) 088-171-027 and 088-171-037 and as shown on Exhibit A attached hereto. 2. DIRECT the Public Works Director, or designee, to complete, sign and submit to the City of Pittsburgh (City) on or before June 16, 2014, on behalf of the County, ballots in favor of levying the Special Tax on each parcel described above. FISCAL IMPACT: No fiscal impact. Bueren, Public Works Director/Chief Engineer Date:June 3, 2014 Contra Costa County Subject:Authorize vote in favor of Community Facilities District No. 2014-1 Special Tax BACKGROUND: (CONT'D) with BART on the design and construction of the eBART line, an extension of BART from the Pittsburg/Bay Point Station to Antioch at Hillcrest Avenue. The City intends for the project to increase mobility across all segments of the population, allow households to save money on transportation and increase social and economic activity in the area. The Community Facilities District No. 2014-1 (Railroad Avenue Specific Plan Area)(“CFD”) has proposed levying a Special Tax on each parcel of real property owned by the County within the CFD beginning in fiscal year 2013-2014. Revenue from the special tax will be used to finance the construction and/or acquisition of certain public facilities in and for the City and the CFD. Public Facilities, include but are not limited to, eBART station on Railroad Avenue and Highway 4, Roadway improvements, construction or improvement of bicycle facilities, construction of public parking. The County owns real property within the CFD. If the CFD’s measure passes, no Special Tax would be levied on land owned by a Public Agency. Therefore, the County would not incur any additional property assessment costs. On June 16, 2014 at 7:00 P.M., the City will hold a public hearing to tabulate all ballots in favor and against the proposed special tax. On or before June 16, 2014, a ballot may be submitted for each parcel of property within the City and/or CFD. The City indicates that each parcel’s ballot is weighed by the proposed amount of the special tax that will be levied against the parcel, and ballots will be tabulated accordingly. The City indicates that if a majority of weighted ballots returned are in support of the special tax, the special tax may be levied for fiscal year 2013-2014. The results of the ballot tabulation will be announced at the City’s Board meeting on June 16, 2014. It is the County’s intention that the parcels will be transferred to a private individual or the City with intention for private ownership in the future. The County may submit ballots for their properties that will be subject to the special tax. A ballot may be submitted for each property. A “yes” vote will be a vote in favor of the special tax. Special tax revenue will fund the construction and/or acquisition of certain facilities within the City and/or CFD. Therefore, Public Works Department staff recommends that the Board of Supervisors approve the submission of a “yes” vote for each of the parcels. CONSEQUENCE OF NEGATIVE ACTION: Each property owner within the boundaries of the CFD has the right to vote on the Special Tax. Failure to approve this action would give up the County’s right to vote. Voting “no” would be a vote against the CFD Special Tax. CHILDREN'S IMPACT STATEMENT: Not applicable. ATTACHMENTS Exhibit A
