HomeMy WebLinkAboutMINUTES - 06032014 - C.132RECOMMENDATION(S): Approve and authorize the Health Services Director, or his designee, to execute, on behalf of the County, Memorandum of Understanding #74–208–11 with the California Department of State Hospitals, a government agency, in an amount not to exceed $4,561,770, for the purchase and use of state hospital beds, including agreeing to indemnify and hold the State harmless for any claims arising out of the County’s performance under the Agreement, for the period from July 1, 2013 through June 30, 2014. FISCAL IMPACT: This Contract is funded 100% by Mental Health Realignment. (Rate Increase) BACKGROUND: In previous years, the agreement to purchase State hospital beds was a part of the Mandated County Performance Contract, as required by Section 5650 of the Welfare and Institution Code. Since fiscal year 2002/2003, the purchase of state hospital beds has been separated from the Performance Contract, making it a stand-alone agreement. The responsibility for administration of this program has since been transferred to the Department of State Hospitals. The County was just notified by the Department of State Hospitals with regard to this renewal agreement. Approval of Memorandum of Understanding #74–208–11 will allow County to continue to compensate the State and the State agrees to provide bed usage, including staffing, facilities, equipment, and supplies through June 30, 2014, including agreeing to indemnify and hold the State harmless for any claims arising out of the County’s performance under the Agreement. CONSEQUENCE OF NEGATIVE ACTION: If this contract is not approved, the County will not be able to pay Contractor for bed usage for mentally ill patients. CHILDREN'S IMPACT STATEMENT: Not Applicable.
