HomeMy WebLinkAboutMINUTES - 06032014 - C.82RECOMMENDATION(S): APPROVE and AUTHORIZE the Conservation and Development Director, or designee, to execute the first amendment to the Bay Area Regional Energy Network (BayREN) contract with the Association of Bay Area Governments (ABAG) to decrease the reimbursement limit by $22,250, from $404,167 to a new reimbursement limit of $381,917, as well as decrease the associated scope of work due to the reduction in California Public Ut ilities Commission (CPUC) grant funding available to the County, with no change to the original term of January 1, 2013 through December 31, 2014. FISCAL IMPACT: There will be no impact to the General Fund. The CPUC grant covers all funding (100%) of this grant program and no matching funds are required. BACKGROUND: In July 2012, the County joined the Bay Area Regional Energy Network (BayREN), a collaborative partnership among the nine (9) Bay Area counties (Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo, Santa Clara, Solano, and Sonoma Counties) and led by the Association of Bay Area Governments (ABAG), which focuses on implementing Energy Efficiency Programs throughout the Bay Area. On July 9, 2013, the County entered into a contract with ABAG in an amount not to exceed $404,167, containing requirements associated with the County's use of California Public Ut ilities Commission (CPUC) grant funding for the period of January 1, 2013, through December 31, 2014. Single-Family Housing Through the statewide Energy Upgrade California brand, using a participating contractor, the BayREN Single Family Program offers free technical services and financial incentives (rebates) to single family homeowners that make specific energy savings improvements to their homes. 2. Multi-Family Housing The Multi-Family energy efficiency retrofit program is similar to the Single-Family Program (above) providing both technical services and financial incentives (rebates) for participating property owners/contractors. This program requires a whole building approach where a scope of work is developed by a contractor requiring completion of at least two (2) energy savings retrofit improvements demonstrating an overall reduction in energy usage of 10% that is verified using specific energy modeling technology. 3. Building Codes and Standards The BayREN Codes and Standards Program promotes an integrated, measurement-driven management process for enhancing energy code compliance. This includes a code compliance needs assessment for jurisdictions in the nine-county Bay Area and will offer targeted training based upon those results to support local government officials with code compliance and enforcement. 4. Energy Efficiency Financing The BayREN Financing Program is developing and launching regional financing options for residential, commercial and multi-family property owners interested in making energy efficiency improvements to their property. Subsequent to the County entering into the contract with ABAG for the BayREN program, the CPUC issued a final decision effective September 2013 that altered previously approved programs falling under the Energy Efficiency Financing strategic area. The decision resulted in a reduction in the overall amount of funding allocated by the CPUC to BayREN. As a result of the Energy Efficiency Financing Program changes made by the CPUC, ABAG is required to amend its contracts with each of the BayREN partner agencies, including the County, to reflect the CPUC approved changes effective last September. This First Amendment incorporates revisions to the Scope of Work for the marketing and outreach associated with the Single-Family Loan Loss Reserve Program and its associated budget of $22,250 under the original subcontract with ABAG. This amendment reduces the total contract limit from $404,167 to $381,917, however the contract term ending on December 31, 2014 will remain unchanged. The County has not incurred expenses in the Program area being eliminated. CONSEQUENCE OF NEGATIVE ACTION: The contract between the County and ABAG would not be consistent with the CPUC's applicable requirements for this grant funding. CHILDREN'S IMPACT STATEMENT: Not applicable under this program.
