APPROVE and ACCEPT the Grant of Easement from Essex Walnut Owner, L. P., a California limited partnership, in
accordance with Section 5 of the Contra Costa County Flood Control and Water Conservation District Act and
DETERMINE that the activity is not subject to the California Environmental Quality Act (CEQA), pursuant to
Article 5, Section 15061(b)(3) of the CEQA Guidelines, Walnut Creek area. [DCD-CP#14-09], Project No.: FCP
FS1300134 (WL83MT);
AUTHORIZE the Chair, Board of Supervisors, to execute the Grant of Easement on behalf of the Contra Costa
County Flood Control and Water Conservation District (District).
DIRECT the Director of Conservation and Development to file a Notice of Exemption with the County Clerk.
AUTHORIZE the Chief Engineer to arrange for payment of a $25 fee to Conservation and Development for
processing, and a $50 fee to the County Clerk for filing a Notice of Exemption.
DIRECT the Real Estate Division of the Public Works Department to cause said Grant of Easement and a certified
copy of this board order to be recorded in the office of the County Clerk-Recorder.
FISCAL IMPACT:
100% Developer Fees.

Environmental Quality Act
BACKGROUND:
The District needs sufficient access to conduct routine and emergency maintenance activities in Las Trampas
Creek channel and Tice Creek culvert.
CONSEQUENCE OF NEGATIVE ACTION:
The District will not have sufficient land rights to access Las Trampas Creek channel and the Tice Creek culvert.
CHILDREN'S IMPACT STATEMENT:
Not applicable.
