HomeMy WebLinkAboutMINUTES - 04292014 - C.09RECOMMENDATION(S): APPROVE and AUTHORIZE the Public Works Director, or designee, to execute the Covenant Running with the Land, Stormwater Management Facilities Operation and Maintenance Agreement, and Right of Entry ("Covenant") with Arbor View Estates LLC for Subdivision (SD) 07-9174, Lafayette area. FISCAL IMPACT: 100% Developer Fees. BACKGROUND: The owner/applicant, Arbor View Estates LLC, has requested a subdivision of nine custom home lots located at 1964 Reliez Valley Road, Lafayette, which is referred to as Subdivision (SD) 07-9174 (Project). As part of the Conditions of Approval for SD 07-9174, the Contra Costa County (County) Department of Public Works has required that the applicant develop an Operations and Maintenance Plan and Stormwater Treatment Facilities (SWTF) for the subject Project, which the applicant has finalized. The County has drawn up and furnished the applicant with the Covenant (attached), the recording of which is a condition of approval of this subdivision. (100% Developer Fees) Project No. 0651-6L0072 BACKGROUND: (CONT'D) the property owner to maintain and perform regular inspections of the stormwater treatment facilities and provides the County with right of entry. The owner has signed the Covenant. A Community Facilities District will be established once the agreement is executed in order to ensure an appropriate mechanism for funding the operations and maintenance of the stormwater facilities. CONSEQUENCE OF NEGATIVE ACTION: The recording of this Covenant is a condition of approval of Subdivision 07-9174. If the Board does not authorize execution of the Covenant, this condition of approval may not be satisfied before the deadline to file the final map. CHILDREN'S IMPACT STATEMENT: Not applicable.
