RATIFY the Public Works Deputy Director's execution of Agreement for Sale of Conservation Credits between the
County and Ohlone Preserve Conservation Bank for the County's purchase of California red-legged frog and
Alameda whipsnake mitigation credits for habitat impacts associated with the Camino Tassajara Shoulder Widening
East of Blackhawk Drive to Finley Road project (0662-6R4131) in the amount of $121,500. (District III)
FISCAL IMPACT:
The project is funded 43% Highway Safety Improvement Program Funds, 15% Proposition 1B Funds and 42% Local
Road Funds.
BACKGROUND:
On September 18, 2012, the Board approved the Camino Tassajara Shoulder Widening east of Blackhawk Drive to
Finley Road project and made related findings under the California Environmental Quality Act (CEQA). The
purpose of the Project is to provide roadway improvements along a 3,500-foot section of Camino Tassajara,
beginning approximately 2,000 feet east of Blackhawk Drive and ending approximately 100 feet south of

BACKGROUND: (CONT'D)
Finley Road. Project implementation will result in permanent impacts to 1.8 acres and temporary impacts to 1.8
acres of California red-legged frog and Alameda whipsnake habitat. The U.S. Fish and Wildlife Service and the
California Department of Fish and Wildlife are requiring purchase of mitigation credits from a U.S. Fish and
Wildlife Service and California Department of Fish and Wildlife approved mitigation bank at a 2:1 ratio for
permanent impacts and 1:1 ratio for temporary impacts to compensate for these impacts resulting in a total of 5.4
acres of credits that must be purchased. Multi-species credits applicable to both species will be purchased from the
Ohlone Preserve Conservation Bank for a total of $121,500.00 to satisfy this requirement.
The Agreement for Sale of Conservation Credits has been approved by the California Department of Fish and
Wildlife and the U.S. Fish and Wildlife Service.
CONSEQUENCE OF NEGATIVE ACTION:
If the execution of the Agreement for Sale of Conservation Credits is not ratified by the Board of Supervisors, the
project would not be in compliance with the Section 7 Endangered Species Act and Section 2081 California
Endangered Species Act environmental consultations for the project.
CHILDREN'S IMPACT STATEMENT:
