HomeMy WebLinkAboutMINUTES - 04292014 - C.03RECOMMENDATION(S): APPROVE and AUTHORIZE the Public Works Director, or designee, to execute an Agreement between the County and the City of Antioch for the Joint Exercise of Powers Relating to the Widening and Maintenance of Somersville Road, Antioch area. FISCAL IMPACT: No fiscal impact. BACKGROUND: In 2003, Discovery Builders, Inc. (Developer) received approval from the City of Antioch for a residential development located westerly of the intersection of Somersville Road and James Donlon Boulevard in Antioch. One of their conditions of approval was to widen Somersville Road between James Donlon Boulevard and the Contra Costa Water District canal bridge, which is not currently a County road or intended to become a County road. Two portions of the project widening area are located in unincorporated Contra Costa County. The City and Developer anticipate that the project widening area will eventually be owned, operated, and maintained as a City street. Until that time, it will be a private roadway, owned by the Developer. Bueren, Public Works Director/Chief Engineer Date:April 29, 2014 Contra Costa County Subject:APPROVE and AUTHORIZE a Joint Exercise of Powers Agreement with the City of Antioch for the widening and maintenance of Somersville Road, Antioch area BACKGROUND: (CONT'D) The purpose of the Agreement between the County and the City of Antioch for the Joint Exercise of Powers Relating to the Widening and Maintenance of Somersville Road (JEPA) is to allow the City to oversee the road-widening project, which will be governed by City road standards, and to maintain the widened road after the City accepts the offer of dedication for the widened road. The County will not participate in any part of administering this project. The JEPA requires Antioch to indemnify the County for any losses arising out of the widening of the road, its maintenance, and use of the widened road. It is expected that Antioch will annex the two portions of the widened road that are located in the unincorporated County in connection with an annexation of adjacent land being undertaken by the City of Pittsburg. CONSEQUENCE OF NEGATIVE ACTION: If this JEPA is not approved, the widening project will be unable to move forward. CHILDREN'S IMPACT STATEMENT: Not applicable. ATTACHMENTS JEPA
