FISCAL IMPACT: The terms and conditions set forth in this action are estimated at a County FY 2013/14 cost of $167,000. Of this amount, $158,500 is the cost to move the date of the 2% increase to base pay, $3,000 is for the two lump sum payments, and $5,500 is for the 3% increase to base pay for the Chief and Lieutenant of Inspectors for the District Attorney and Welfare Fraud. The FY 2014/15 cost is estimated to be $157,500 for the $500 lump payment and $45,000 for the Chief and Lieutenant of Inspectors for the District Attorney and Welfare Fraud. In an effort to continue that tradition and to share the burden of those difficult economic times, the Board of Supervisors modified the wages and benefits for its unrepresented employees to be consistent with those of Local 21. The modification was a 2.75% reduction in base rates of pay as of October 1, 2011. The County began bargaining with Local 21 in the Spring of 2012 and negotiations stalled on two key issues: potential salary increases, and the employees’ costs for health insurance. Local 21 demanded pay increases and increases in health insurance subsidies and other items that far exceed the County's fiscal resources. The County has been very clear that retroactive wage increases would not be granted. Rather than waiting for a settlement with Local 21, thereby reducing the benefit for unrepresented management offered to Local 21, in August of 2013 the County Administrator recommended a wage increase and lump sum payment for Appointed Department Heads, Management, Exempt and Unrepresented Employees. On August 13, 2013, the Board of Supervisors approved Resolution No. 2013/318, which provided a 2.0% increase in base pay for the County Administrator, Appointed Department Heads, Management, Exempt, and Unrepresented Employees including Contra Costa County Retirement Association employees for the period of August 1, 2013 and beyond; a 2.0% increase in base pay for the period of July 1, 2014 and beyond; and a lump sum payment of $1,000 for employees as specified in the Resolution. Professional & Technical Engineers Local 21, AFL-CIO and the District Attorney Investigators' Association have recently negotiated new Memoranda of Understanding. Resolution No. 2014/109, modifies Resolution 2013/318 to align unrepresented managers wage increases with the the agreement bargained with these groups. The following summarizes Resolution No. 2014/109 (attached), which modifies the original wage increase adopted August 13, 2013: Provides for a 2.0% salary increase for the County Administrator, Appointed Department Heads, Management, Exempt, and Unrepresented Employees (excluding County attorneys and CCCERA) for the period April 1, 2014 and beyond. Contra Costa County has historically tied unrepresented attorney classes to the represented classes in the Contra Costa Defenders' and Deputy District Attorneys' Associations for purposes of salary parity. On November 6, 2012, the Board of Supervisors adopted new memoranda of understanding with the Contra Costa Defenders' and Deputy District Attorneys' Associations that included wage increases. On December 4, 2012 the Board of Supervisors adopted Resolution No. 2012/495 which increased unrepresented attorney classification salaries by 1.5% effective July 1, 2013 and 2.0% effective January 1, 2014 in order to re-establish parity with represented attorney classes by the end of fiscal year 2014/2015. 1. Rescinds the 2.0% salary increase for the County Administrator, Appointed Department Heads, Management, Exempt, and Unrepresented Employees (excluding County attorneys and CCCERA) previously approved for July 1, 2014. 2. Provides for a 3.0% salary increase for the DA Chief of Inspectors-Exempt, DA Lieutenant of Inspectors, and Lieutenant of Inspectors Welfare Fraud effective April 1, 2014, July 1, 2014, and July 1, 2015. 3. Provides employees #35313 and 52452 with a one-time lump sum payment of $1,000 for the payment they missed in 2013. 4. Provides for a $500 lump sum payment for the County Administrator, Appointed Department Heads, Management, Exempt, and Unrepresented Employees of the County on April 1, 2015. 5. Provides for a 3.0% salary increase for the County Administrator, Appointed Department Heads, Management, Exempt, and Unrepresented Employees (excluding County attorneys and CCCERA) for the period July 1, 2015 and beyond. 6. CONSEQUENCE OF NEGATIVE ACTION: The County could be detrimentally impacted by the potential loss of highly-trained personnel and it may become more difficult to attract candidates for promotion.
