APPROVE and AUTHORIZE the Fire Chief to terminate the Amended and Restated Fire Fighting Services
Agreement between the Contra Costa County Fire Protection District and the City of Pinole, in which the City of
Pinole provides fire protection and emergency medical response services in the unincorporated communities of Tara
Hills and Bayview in exchange for payment from the Contra Costa County Fire Protection District.
FISCAL IMPACT:
Minimum annual cost savings of $150,000.
BACKGROUND:
In November of 1980, the Contra Costa County (County) Board of Supervisors and the City of Pinole (City) entered
into an agreement for the provision of fire protection services by the City to the County Board-governed Pinole Fire
Protection District. The contract was automatically renewed from year to year. The annual fee was based on an
allocation of direct fire and communications costs plus an overhead factor for administration. The County was
charged a percentage of the fire protection cost based on the amount of the assessed valuation in the unincorporated
area in relation to the amount of the total assessed valuation, both in the incorporated and unincorporated

Effective July 1, 1994, the Pinole Fire Protection District was annexed to the Contra Costa County Fire Protection
District (District). Accordingly, the Contra Costa County Fire Protection District was then responsible for the fire
protection services in the area of the former Pinole Fire Protection District (including the communities of Tara
Hill, Bayview, and Montara Bay and the Alhambra Valley corridor).
Effective July 1, 2012, the District and the City entered into an Amended and Restated Fire Fighting Services
Agreement (Agreement) (attached). Under the amended Agreement, the payment methodology was changed from
a flat fee with an annual escalator to a "per call" basis with a minimum annual payment of $150,000. Since the
amended Agreement has been in effect, the District has paid the minimum annual payment of $150,000.
The District's communications center, which also dispatches for the City of Pinole Fire Department, currently
dispatches the closest available resource(s) regardless of agency borders. Due to the reduction in available
resources in the Pinole Fire Department, the District now provides more aid to the City of Pinole than the City
does to the District, and the District receives no payment for this. Therefore, it does not seem reasonable for the
District to continue paying the City for fire protection and emergency medical services when the District receives
fewer resources than it provides.
The amended Agreement automatically renews for a one year period on each anniversary of the effective date of
the Agreement unless one party provides the other party with notice of cancellation at least 60 days prior to the
anniversary of the effective date. The next anniversary of the effective date is July 1, 2014.
CONSEQUENCE OF NEGATIVE ACTION:
The Fire Chief will not provide the City of Pinole with notice of termination of the Agreement. Consequently, the
Agreement will automatically renew on July 1, 2014, and the District will continue to pay at least $150,000
annually to the City for the services described in the Agreement despite not receiving in-kind services or payment
from the City in return.
