(Project No. 4500-6G5593 ) DIRECT the Real Estate Division to have the above referenced Second Amendment to Grant of Easement recorded in the office of the County Recorder. FISCAL IMPACT: 100% Contra Costa Water District Funds. BACKGROUND: In 1977 Southern Pacific Transportation Company (SPTC) granted an easement to Contra Costa Water District (CCWD) that did not clearly define the exact location of the easement. Bueren, Public Works Director/Chief Engineer Date:March 25, 2014 Contra Costa County Subject:Approve the Second Amendment to Grant of Easement with Contra Costa Water District in 1977, Concord Area. BACKGROUND: (CONT'D) included CCWD’s easement. CCWD is now replacing a portion of its water main pipeline located within the IHC between the south side of Monument Boulevard and north side of Lisa Lane in the City of Concord. As part of the replacement, CCWD has requested to relocate the existing easement to another area of the IHC so their water pipeline will be away from tree roots that are severely damaging the existing water pipeline. The County agreed to have the District relocate a portion of the easement area to a new easement area within the IHC with the provision that they provide the County with a metes and bounds legal description and plat map clearly showing the location of the new easement area. The District also agreed to quitclaim all its rights to the portion of the old easement area located between Monument Boulevard and Lisa Lane to the County. The County and CCWD entered into an Amendment to Grant of Easement in 2009 for the relocation of a portion of CCWD’s water pipeline located in the IHC between Walden Road in Walnut Creek to just north of Treat Boulevard in Pleasant Hill. The Second Amendment to Grant of Easement is to change the location of the undefined easement between Monument Boulevard and Lisa Lane to a defined easement area in the IHC. The District has now determined and mapped the proposed location of the new pipeline facility and would now like to amend a portion of the legal description and plat map to the original Grant of Easement, recorded on September 13, 1977 in Book 8500 at Page 895 of the Official Records of Contra Costa County. All other terms and conditions of the original grant of easement will remain in full force and effect. In December of 1984, the Board of Supervisors determined that the acquisition of the IHC from SPTC would not have a significant effect on the environment, and that it had reviewed and considered the Initial Study and Negative Declaration together with any comments received during the public review process (all of which are on file with the Board), and approved its adequacy for California Environmental Quality Act purposes. CONSEQUENCE OF NEGATIVE ACTION: The easement will not accurately reflect the location of the pipeline. CHILDREN'S IMPACT STATEMENT: Not applicable. ATTACHMENTS Second Amendment to Grant of Easement
