CONSIDER waiving the 180 day "sit out period" for Sandra Marsh, Mental Health Program Manager, Behavioral Health Division, Health Services Department. 3. FIND the appointment of Ms. Marsh as necessary to fill a critically needed position; and 3. APPROVE and AUTHORIZE the hiring of County retiree Sandra Marsh as a temporary County employee effective immediately and continuing for a period of six months. FISCAL IMPACT: Upon approved, this action will not result in any additional cost. Salary costs are included in the current Behavioral Health Division budget. BACKGROUND: The Public Employee Pension Reform Act of 2013 requires that active members who retire on or after January 1, 2013, must wait 180 days after retirement before returning to work as a temporary employee. The Act also allows the Board, based on a finding that the appointment is necessary to fill a critically needed position, may waive the 180 day "sit out" period. Ms. Marsh's position was in charge of the development and implementation of a legal settlement referred to as Katie A. The Katie A mandate is a comprehensive structural transformation in how Child and Family Services and Children’s Mental Health work together to improve service delivery to youth who are in or at risk of entering the foster care system. As the principle architect from Behavioral Health, Ms. Marsh worked in close partnership with Employment and Human Services to ensure fidelity to the core principles and guidelines administered by the State. A State review panel oversees the County's implementation to ensure that these guidelines are met.There are no other Program Managers in the Children’s System of Care available to pick up this responsibility. As a result, there is no resource to draw on to manage this very significant, legally mandated, program development and implementation. With Ms. Marsh's retirement, the Behavioral Health Division will conduct a recruitment fo fill the vacancy. However, this process can take several months with additional time needed for training and transition. The loss of this Mental Health Program Manager position will severaly impact the ability of Behavioral Health to develop and implement this legally mandated program. As such, the Health Services Department requests the temporary hire of Ms. Marsh for a period of six months to allow for recruitment and transition. CONSEQUENCE OF NEGATIVE ACTION: If this action is not approved, the Behavioral Health Division will be unable to manage a significant and legally mandated program.
