A. FIND that the proposed Grant Deed of Development Rights between Golden Oak Development, Inc., and Contra
Costa County, a copy of which is attached hereto (“Grant Deed”), is categorically exempt from the review
requirements of the California Environmental Quality Act (Class 25 - Transfers of Ownership of Interest in Land to
Preserve Existing Natural Conditions).
B. APPROVE and AUTHORIZE the Board Chair to execute the Grant Deed.
C. ADOPT Resolution No. 2014/69, accepting the Grant Deed.
D. DIRECT the Conservation and Development Director to have a certified copy of Resolution No. 2014/69 and the
Grant Deed recorded in the Office of the Contra Costa County Recorder.
FISCAL IMPACT:
None to General Fund. All costs are absorbed by applicant.
BACKGROUND:
On October 10, 2006, the County Planning Commission approved an application by Golden Oak Development, Inc.,
for an 11-lot subdivision in an unincorporated area near Martinez

Subject:ADOPT Res No. 2014/69 accepting Grant Deed of Development Rights on a Portion of the Hillside Estates
Subdivision in the Martinez area. (District V)
BACKGROUND: (CONT'D)
(County File #SD05-9004). The Board of Supervisors approved a related rezoning and development plan on
December 12, 2006 (County Files #RZ05-3172 and #DP05-3101). On April 18, 2011, the County Zoning
Administrator approved a new development plan for the subdivision (County File #DP10-3009). Conditions of
approval of #SD05-9004 and #DP10-3009 require the applicant to grant development rights to the County over a
portion of the subdivision property that consists of slopes greater than 26 percent and is not suitable for
development.
CONSEQUENCE OF NEGATIVE ACTION:
If the Board does not accept the Grant Deed, the development rights over the identified area will not be conveyed
to the County. This may result in the future development of a hillside which has been deemed unsuitable for
structural development.
CHILDREN'S IMPACT STATEMENT:
