SPECIFIC REQUEST(S) OR RECOMMENDATION(.S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Acknowledge receipt of report from Health Services Director on
the volume of Hazardous Wastes disposed of at the two Class I
landfills in the County.
BACKGROUND:
When the Board of Supervisors increased the hazardous waste tax
in October, 1984 (effective December 1, 1984) , the Board asked
the Health Services Department to monitor the volumes of
hazardous wastes being disposed of at the two Class I sites in
the County in an effort to determine whether there is any
indication that the increase in the tax may have contributed to
an increase in illegal dumping.
The Health Services Director has now filed a report updating an
interim report presented to the Board in July, 1985 . This
report, which reports volumes disposed of through June, 1985
concludes that there is no evidence of any reduction in volumes,
of hazardous wastes being disposed of at the two Class I sites.
There is a dramatic increase in untreated wastes reported at the
IT facility, and a corresponding decrease in treated waste which
the company is checking on to determine whether there is a
reporting error or some major shift in the wastes being received
by the facility. However, overall the total amount of hazardous
waste disposed of does not appear to have been affected by the
increase in the tax.
No further action is required by the Board other than to
acknowledge receipt of this report.

On October 16, 1984, the Board of Supervisors adopted Resolution 84/624
increasing the hazardous waste disposal tax in off-site Class I landfills in
Contra Costa County. We have been monitoring the volumes of hazardous wastes
disposed of at the I.T. and West Contra Costa Sanitary Landfill Class I facili-
ties respectively in response to an expressed Board concern_ that the disposal
tax may induce illegal dumping.
A preliminary report dated June 27, 1985, (copy attached) evaluated volumes of
hazardous wastes disposed of at the two facilities during the period from
February, 1984 through February, 1985. No significant changes in volumes of
hazardous wastes disposed of at the two off-site Class I facilities were evident.
This follow-up report includes the volumes of Class I wastes disposed of at both
facilities through June, 1985 (tables attached). The total quarterly volumes of
hazardous wastes disposed of at the I.T. facility is unchanged. However, the
total volume of treated hazardous wastes has decreased markedly over the volumes
previously reported and the relative volumes of non-treated hazardous wastes
disposed of has increased correspondingly during the same reporting period from
March through June,—1-985, as compared with the prior reporting periods. I.T.
Corporation staff have been unable to provide a reason for the variation in
reported hazardous waste types but has ordered an internal audit to disclose the
reasons for this substantial change in the ratio of treated vs. non-treated
hazardous wastes. The amount of tax owing to the County is greater for non-
treated wastes than for treated wastes. This incentive to treat hazardous
wastes prior to disposal is, therefore, apparently not achieving the intended result.
The total quarterly truck loads of Class I and Class II-I hazardous wastes
reported by West Contra Costa Sanitary Landfill for April , May, and June, 1985,
has increased, but has not varied substantially over the prior reporting period.
Our review of the data reported from February, 1984, through June, 1985 indica-
tes that the County tax on hazardous wastes disposed of in the two off-site
Class I landfill facilities in Contra Costa County has not influenced the total
hazardous waste volumes disposed of in this County. "

The following information is in response to your May 22 letter concerning volume
data- for hazardous waste disposed of at the I.T. and West Contra Costa Sanitary
Landfill Class I disposal sites. Your request was in response to Resolution
84-624 adopted by the Board of Supervisors on October 16, 1984.
The current procedure for tax billings by the Auditor's office to the two
referenced Class I landfills involves the landfill company providing the
County Auditor with a worksheet stating total tonnage and/or truckloads,
type, and rate on a monthly basis. The Auditor then issues invoices and
receipts for payment to the respective hazardous waste disposal sites. This
process figures fees in arrears and there is a lag time of several months. Last
payment for I.T. was February, 1985 and last payment for West Contra Costa
Sanitary Landfill was March, 1985, therefore, I only have relevant data to
respond to your request effectively for one quarter, December, 1984, January,
1985 and February, 1985. I am attaching for your review accumulative totals
figured quarterly from December, 1984 through February, 1985, which is the best
available data since approval of the tax increase by the Board in December,
1984. I have additionally figured quarterly totals from the best data
available, including November, October, September, August, July, June of 1984
and the months of May, April and February, 1984 for I. T. ; and the months of
May, April , March of 1984 for West Contra Costa Sanitary Landfill . The month of
April, 1984 was not reported in information transmitted to us from the Auditor's
office for I.T. Corporation and is, therefore, not included in this worksheet.
The range of total tonnages for the four quarters' information presented
spans 41,800 tons to 47,360 tons of hazardous waste disposed during the
three quarters prior 'to the tax increase. For the one quarter since the tax
increase, the total tonnage is 44,178. There is no apparent decrease in the
volume of hazardous waste disposed of based on one quarter's data.

For West Contra Costa Sanitary Landfill , there is insufficient information
regarding tonnage to reach any valid conclusion, however, the number of
truckloads would not indicate any reduction in hazardous waste being transported
to this site.
I hope this information is helpful for updating purposes or if you wish to
transmit preliminary data to the Board. In any case, I would not expect to have
information for the months of March, April, and May until sometime in August,
1985. At that point, I can prepare a follow-up statement on these issues. If
you need any additional information, please let me know.
