ADOPT Resolution No. 2013/461 approving the Side Letter between Contra Costa County and the Deputy District
Attorneys’ Association to supersede and replace subsection B.i. of Section 28 to qualify for a $2,000 reimbursement
for law school student loan payments employees who, either during or upon completion of the third consecutive year
of employment as a full-time Deputy District Attorney-Fixed Term, are employed as a Deputy District Attorney –
Basic Level.
FISCAL IMPACT:
The cost of this change is $2,000 for each individual will now qualify for the reimbursement without serving the full
three year previously required period. It is estimated that less than one person per year will fall into this category.
BACKGROUND:
The existing Memorandum of Understanding (MOU) between Contra Costa County (County) and the Deputy District
Attorneys’ Association (Association) currently provides in Section 28.B.i.: “After completion of the third full year of
employment as a fixed term employee” an employee is eligible for certain student loan benefits.

BACKGROUND: (CONT'D)
There are circumstances under which the District Attorney may find it necessary to promote an employee from
“fixed term” to regular employee prior to the completion of the third year. Based upon this need, the County and
the Association have agreed to amend the MOU to provide the student loan benefit to employees who become
full-time Deputy District Attorney-Fixed Term “during” their third consecutive year of fixed term employment, to
comply with the intent of the language.
CONSEQUENCE OF NEGATIVE ACTION:
Employees technically short of three complete years of employment will be prevented from accessing this benefit.
