APPROVE and AUTHORIZE the Agricultural Commissioner, or his designee, to execute Agreement #13-0166
High-Risk Exclusion with the California Department of Food and Agriculture in an amount not to exceed $15,977 to
perform "Pest Exclusion/High Risk Inspections and Enforcement", for the period of July 1, 2013 through June 30,
2014.
FISCAL IMPACT:
This agreement will reimburse the department up to $15,977 to support inspection and enforcement activities on
behalf of the California Department of Food and Agriculture (CDFA) in Contra Costa County. There is no cost share
requirement and the revenue from this agreement has been anticipated in the departmental FY 13/14 budget.
BACKGROUND:
Legislation in 1997 encouraged a study to be conducted to evaluate the statutory and regulatory responsibilities and
appropriate funding sources for county agricultural commissioner programs. The study placed priority upon the pest
exclusion program and identified opportunities for improving and funding mandated activities.
In 1998 legislation was passed as a result of this study. The legislation

BACKGROUND: (CONT'D)
was geared toward funding high-risk exclusion activities performed by the county agricultural commissioners through
out the State.
Agreement #13-0166 sets activity levels that are designed for Contra Costa County based on historical workloads,
costs on negotiated work plan to maintain optimal services tests. This agreement does not cover the entire cost of
high-risk activities in the county but, improves the service level in regards to enforcement of quarantines that are
designed to keep exotic and invasive pests out of California and Contra Costa County.
Under the agreement, the Department will perform high-risk parcel inspections at terminals or other facilities per
Food and Agricultural Code (FAC) Division 2, Chapter 2, Article 8, Section 2282.5 (Appendix A) and FAC Division
4, Part 2, Chapter 1, Article 1, Section 6303 (Appendix B) and FAC Division 4, Part 2, Chapter 2, Article 1, Sections
6401 and 6403.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to accept Agreement #13-0166 will mean that the Department will be unable to hire employees to support
inspections and enforcement activities.
