ADOPT Resolution No. 2013/460 approving the second extension of the Subdivision Agreement for subdivision SD
06-08993, for a project being developed by Hofmann Land Development Co., as recommended by the Public Works
Director, Discovery Bay area. (District III)
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
The Subdivision Agreement needs to be renewed, as the improvements are not completed yet. (Approximately 5% of
the work has been completed to date.) The developer has requested additional time to complete improvements.
The developer has requested a two-year extension because of the current lag in the housing market and slow
economic recovery.
Granting an extension gives the developer additional time to complete the improvements and keeps the bonding
current.

Subject:Approving the second extension of the Subdivision Agreement for subdivision SD 06-08993, Discovery Bay area.
CONSEQUENCE OF NEGATIVE ACTION:
The Subdivision Agreement will not be renewed if the extension is not granted; the developer cannot complete the
improvements; the bonds cannot be kept current; and, the County may need to foreclose on the developer’s bonds
and complete the improvements.
