(applicant/owner) to establish an private helicopter landing area in the Discovery Bay area. This being the time for hearing on the recommendation of the County Planning Commission with respect to application for Land Use Permit No. 2088-85 filed by New Discovery, Inc. (applicant/owner) , to establish a private helicopter landing area in the Discovery Bay area; and Harvey Bragdon, Assistant Director of Community Development, described the property site and advised that a Negative Declaration of Environmental Significance was posted for the project; and The Chairman opened the public hearing and, no one having appeared in opposition, the public hearing was closed. Supervisor Torlakson expressed the need for an additional condition that any cost of enforcement of the Land Use Permit would be at the expense of the applicant. Development of the site shall be as shown on the plot plan submitted with the application and dated received by the Community Development Department on June 27, 1985. 2. This approval allows the use of the site by one helicopter for private use of New Discovery, Inc. The permit is not transferable. 3. Hours of operation shall be from 7:00 a.m. to 6:00 p.m. on weekdays and from 8:00 a.m. to 6:00 p.m. on weekends. 4. The telephone line noted on the F.A.A. letter dated June 18, 1985, shall be marked with red day glow balls and night reflective panels. 5. The helicopter pad shall be correctly marked per State/Federal standards. 6. No construction of the pad or use of the site for helicopter operations shall be undertaken prior to Federal Aviation Administration and State Department of Transportation, Division of Aeronautics approval. 7. The concrete touchdown pad shall have a minimum dimension of 15' x 201. A takeoff and landing area, with a dust free surface at least 1.5 times the overall length of the largest helicopter expected to use the facility shall be provided. 8. Install a peripheral area as an obstacle-free safety area surrounding the take-off and landing area. The peripheral area shall be one-fourth the overall length and the largest helicopter expected to use the facility, or 10 feet, whichever is greater. 9. The approach-departure paths shall be restricted to southerly and northerly flight paths. These approach-departure paths may be modified if the applicant can provide documentation to demonstrate alternate flight paths, offer better prevailing winds and create no safety hazards for surrounding properties. Acceptable angles between approach-departure paths shall be no less that 90 degrees. 10. the heliport primary surface shall extend outward and upward for a horozontal distance f 4,000 feet where its width is 500 feet. The slope of the approach surface shall be 8 to 1. The heliport transitional surface shall extend outward and upward from the lateral boundaries of the heliport primary surface and from the approach surfaces at a slope of 2 to 1 for a distance of 250 feet measured horizontally from the centerline of the primary and approach surface. 11. The helicopter must maintain an enroute altitude of no less than 750 feet. 12. Applicant must provide confirmation of review and action by the Airport Land Use Commission prior to final approval. 13. Any cost of enforceroent, of this land use permit shall be at the expense of the applicant. 1-21-86
