after January 1, 2014, who, under PEPRA, become New Members of CCCERA to provide that the cost of living adjustment to

the period December 1, 2013 and beyond; a 2% increase in base pay for the period July 1, 2014, and beyond, and a lump sum

D.8 HEARING to consider adoption of Ordinance No. 2013-24 to adopt the 2013 California Building, Residential, California
Green Building Standards, Electrical, Plumbing Code, and Mechanical Codes, with changes, additions, and deletions, including
adoption of related California Environmental Quality Act findings. (Jason Crapo, Department of Conservation and
Development)
CLOSED the public hearing;
ADOPTED Ordinance No. 2013-24, adopting the 2013 California Building Code, the 2013 California Residential Code,
the 2013 California Green Building Standards Code, the 2013 California Electrical Code, the 2013 California Plumbing
Code, and the 2013 California Mechanical Code, with changes, additions, and deletions;
ADOPTED findings in support of the County’s changes, additions, and deletions to the statewide codes;
DIRECTED the Department of Conservation and Development, pursuant to Health and Safety Code section 17958.7, to
send a certified copy of Ordinance No. 2013-24, the attached findings, and this Board Order to the California Department
of Housing and Community Development and to the California Building Standards Commission;
FOUND that the adoption of ordinance is exempt from CEQA pursuant to CEQA Guidelines section 15061(b)(3).
DIRECTED staff to file a Notice of Exemption with the County Clerk.

and Preliminary and Final Development Plan for the Pantages Bay Residential Subdivision, including 292 residential lots,
creation of bays and widening of Kellogg Creek at the east end of Point of Timber in the Discovery Bay area; CONSIDER
adoption of Resolution No. 2013/421 and Ordinance No. 2013-16 to effect the Planning Commission recommendations, and
adoption of related California Environmental Quality Act findings. (Pantages at Discovery Bay, LLC - Applicant) (C & D

CEQA Guidelines, and that it reflects the County’s independent judgment and analysis;
CERTIFIED the Environmental Impact Report for the Pantages Bay Residential Development Project, and ADOPTED
the Mitigation Measures and the Mitigation Monitoring and Reporting Program (MMRP) contained therein;
ADOPTED the General Plan Amendment (County File No. GP99-0008) to re-designate approximately 171 acres of the
project site in the Discovery Bay community from Agricultural Lands (AL) and Delta Recreation and Resources (DR) to
Single Family Residential – High Density (SH), Single Family Residential – Medium Density (SM), Public/Semi-Public
(PS), Open Space (OS), and Water (WA), and as illustrated on the map included as Exhibit 2 as of part of the 2nd
Consolidated General Plan Amendment for calendar year 2013;
ADOPTED the Rezoning (County File No. RZ04-3146) of the approximately 171 acre project site in the Discovery Bay
area from the A-2, General Agricultural District and A-3, Heavy Agricultural District to a P-1, Planned Unit District),
and as illustrated on the map included as an Exhibit 3;
APPROVED the Preliminary and Final Development Plan for the Pantages Bays Residential Development Project with
the recommended and amended Conditions of Approval (County File No.DP04-3062) ;
ADOPTED Board Resolution No. 2013/421, which incorporates the project findings, CEQA Findings with statement of
overriding consideration and conditions of approval as the basis for the Board’s approval of the Pantages Bays
Residential Development Project;
INTRODUCED the ordinance giving effect to the aforementioned Rezoning, WAIVED reading, and ADOPTED
Ordinance No. 2013-16;
DIRECTED staff to post the Notice of Determination for the project with the County Clerk.

D.10 HEARING on the proposed General Plan Amendment involving a modification to the Roadway Network Map, Figure 5-2,
Transportation-Circulation Element, affecting a segment of Appian Way within the community of El Sobrante; CONSIDER
adoption of Resolution No. 2013/443 and related California Environmental Quality Act findings, as recommended by the
Conservation and Development Director. (Patrick Roche, Department of Conservation and Development)
ACCEPTED report and recommendation from the Director on the "Appian Way Alternatives Analysis and Complete Streets
Study" (Final Report, June 2013), prepared for the Contra Costa Transportation Authority in association with Contra Costa
County and City of Pinole;
CLOSED the public hearing;
FOUND that the Environmental Impact Report (EIR) originally prepared for the Downtown El Sobrante General Plan
Amendment (SCH#2002102119) and certified by the Board of Supervisors on June 7, 2011, including the Draft and Final
provided under separate cover, involved an extensive review and evaluation of the environmental effects associated with
changes to the roadway network in El Sobrante, including Appian Way, and that this EIR certified in June 2011 is adequate for
purposes of compliance with the California Environmental Quality Act (CEQA) for the adoption of this General Plan
Amendment modifying the Roadway Network Map for Appian Way;
APPROVED an amendment to modify the Roadway Network Map, Figure 5-2, Transportation-Circulation Element;
ADOPTED Resolution 2013/443 giving effect to this modification of the Roadway Network Map as the 3rd Consolidated
General Plan Amendment in calendar year 2013 as provided under state law;
DIRECTED the Department of Conservation and Development to post the CEQA Notice of Determination with the County
Clerk for the General Plan Amendment to modify the Roadway Network Map; and
REQUESTED the Public Works Department to report back to the Transportation Water and Infrastructure Committee on a
program to implement the recommendations from the “Appian Way Alternatives Analysis and Complete Streets Study" within
6 months of the General Plan Amendment adoption.

attendant investigation at the written request of the decedent’s legal next of kin completed by the Office of the Sheriff-Coroner.

All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be
no separate discussion of these items unless requested by a member of the Board or a member of the public prior to the time the Board
votes on the motion to adopt.
Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those
persons who are in support thereof or in opposition thereto. After persons have spoken, the hearing is closed and the matter is subject to
discussion and action by the Board. Comments on matters listed on the agenda or otherwise within the purview of the Board of
