APPROVE and AUTHORIZE the Sheriff-Coroner, or designee, to enter into an memorandum of understanding with
California Highway Patrol (CHP), including mutual indemnification, to provide the County with a Rotation Tow List
including tow companies that have been inspected and satisfy CHP requirements for a continuous term effective
October 1, 2013 unless terminated unilaterally by either party with 30 days advance written notice or immediately by
written mutual consent.
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
California Vehicle Code Section 2424 allows the California Highway Patrol ("CHP") to enter into agreements with
providers of towing, emergency road and storage services ("TSA"). The TSA requires tow operators to meet certain
minimum requirements to participate on the California Highway Patrol's rotation tow list and remain on the tow list.
The TSA ensures that the tow operators on the rotational tow list are competent to respond to calls with minimal
delay. California Highway Patrol will share a list of tow companies that have been inspected

BACKGROUND: (CONT'D)
and satisfy the requirements necessary to be included on the CHP Salvage and Recovery Tow Service List
("Rotational Tow List"). The Office of the Sheriff will request a current Rotational Tow List for the CHP Martinez
office on an annual basis. The Office of the Sheriff will contact CHP at least every six (6) months to determine if any
tow companies have been removed or added from the approve CHP rotational tow list.
CONSEQUENCE OF NEGATIVE ACTION:
A negative vote on this agreement would force the Office of the Sheriff to complete checks of tow companies . The
Office of the Sheriff employees would be required to physically go out and inspect all tow companies that apply on
the list. A negative action would cost the Office of the Sheriff time and ultimately money to inspect each tow
company.
