SUBJECT: MANDATORY RECYCLING--CONDITION FOR (�1 ���/
NEW SANITARY LANDFILL SITES
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION
Approve in concept the issue of requiring, through the land use permit
process, that new landfills only accept waste from communities where
curbside recycling programs exist or are in the process of being imple-
mented. Also, refer this issue to the Solid Waste Commission for further
review and suggestions as to how such a concept could best be implemented.
FINANCIAL IMPACT
There is no financial impact to study this issue. With the implementation
of this recommendation, there could be additional costs for equipment and
service, but it is also very possible that overall garbage rate for
recycling consumers could go down significantly.
REASONS FOR RECOMMENDATION/BACKGROUND
In a memo to the Internal Operations Committee, dated May 10, 1985, County
Counsel reported that "under the police power, the County may be able to
impose an entitlement condition upon the operation of a privately owned
landfill requiring that, with respect to communities capable of establish-
ing curbside recycling, only waste from those communities with such a
program be accepted. However, depending upon the facts, such a condition
could conflict with State law and be subject to legal challenge. "
The Recycling Committee believes that curbside recycling programs should be
implemented throughout the County in urban aras where it is feasible and
that the above requirement would spur the implementation of such recycling
programs. The Committee believes that recycling will be one important
method of reducing the amount of garbage going into new landfill sites and
will thus lengthen the life of new landfills while reducing overall
impacts to the environment.
Since the County is not involved in franchising solid waste
collection, but is involved with regulating new landfills, this method will
be a way for the County to stimulate more recycling in the county.
Since this issue would require the involvement and cooperation of virtually
every franchising agency in the County, it is appropriate for the Solid
Waste Commission to discuss this matter and to report back to the Board of
Supervisors with additional feedback on how the concept might be
implemented.
