HomeMy WebLinkAboutMINUTES - 12032013 - C.46RECOMMENDATION(S): APPROVE Appropriation and Revenue Adjustment No. 5016 authorizing revenue in the amount of $123,918 from restricted civil revenue and appropriating it to the Sheriff's Civil Unit for fiscal year 2013/14 projected expenditures. FISCAL IMPACT: This action increases estimated revenue and expenditure appropriations by $123,918. There is no change in net county cost. BACKGROUND: The Civil Unit of the Office of the Sheriff carries out legal mandates of the Government Code and Code of Civil Procedure to serve all processes of the courts which are delivered to the Sheriff. These include but are not limited to: collecting money from wage garnishments and bank levies, performing evictions, serving restraining orders and civil bench warrants, and enforcing civil judgments. AB1109 and AB709 allow for assessment of civil process and civil processing fees. Civil Process Fees are required to be charged when the Office of the Sheriff enforces civil actions or levies on property or assets to satisfy monetary judgments. Both of these fees are restricted for use by the Civil Unit of the Office of the Sheriff for a vehicle program and an automation program respectively. CONSEQUENCE OF NEGATIVE ACTION: The Sheriff's fiscal year 2013/14 operating budget for the Civil unit will not reflect anticipated revenue and expenditures. CHILDREN'S IMPACT STATEMENT: No impact.
