FIX a public hearing for December 17, 2013 at 9:30 a.m. to consider adoption of Ordinance No. 2013-26 establishing
transportation mitigation fees to be imposed on new development within the East County Regional Area of Benefit
(AOB), as recommended by the Public Works Director.
DIRECT the Clerk of the Board to publish the Notice of Public Hearing in accordance with Section 6061 of the
California Government Code.
DIRECT the Public Works Director to mail the Notice of Public Hearing in accordance with Government Code
sections 65091 and 66484.
FISCAL IMPACT:
The County will incur the cost to publish and mail the notice of the hearing, as required by the applicable Government
Code Statutes. These costs will be paid from the East County Regional AOB fund, pursuant to Government Code
section 66018, subdivision (b).

Subject:FIX Hearing date to consider adoption of an ordinance establishing mitigation fees within the East County Regional
Area of Benefit
BACKGROUND:
The Countywide Area of Benefit (AOB) was first adopted by the Board of Supervisors on March 15, 1988 to
improve the capacity and safety of the arterial road network in unincorporated Contra Costa County through the
establishment of a traffic mitigation fee. The Countywide AOB was initially divided into seven regions. The seven
regions were named West County, Central County, Lamorinda, Alamo, South County, East County and Bethel Island.
In 1993, the Board created seven regional areas of benefit within the Countywide AOB, which for the most part
shared the boundaries of the regions. One of these new regional areas of benefit was the East County Regional AOB.
Fees in the East County Regional AOB were last updated in 1997. Since that time, several of the improvements
funded by the East County Regional AOB fee revenues have been constructed, significant development has occurred,
and the circulation needs for the region have changed.
County Staff and consultants have identified transportation improvements that are necessary to serve traffic demands
within the East County Regional AOB through 2030, including traffic impacts that will be produced by new
development. In order to fund new developmentās share of these traffic improvements, the Board will need to hold a
hearing to consider adopting an ordinance to establish and impose a fee on new development within the East County
Regional AOB. This Board Order fixes the hearing for December 17, 2013 at 9:30 a.m., and directs staff to publish
and provide notice of the hearing, as required by the applicable Government Code statutes.
CONSEQUENCE OF NEGATIVE ACTION:
A public hearing would not be set, notice would not be given and the proposed ordinance could not legally be acted
on by the Board.
