HomeMy WebLinkAboutMINUTES - 11122013 - C.40RECOMMENDATION(S): APPROVE and AUTHORIZE the Chief Engineer, Contra Costa County Flood Control and Water Conservation District, or designee, to execute a settlement between the Contra Costa County Flood Control and Water Conservation District (District) and Dennis Chow and Monica Mui Ung (Tenants) regarding Tenants’ possession of Flood Control District property located at 1420 Livorna Road, Alamo. FISCAL IMPACT: No fiscal impact. However, the District anticipates receiving a minimum of $425,000 from the subsequent sale of the property once the Tenants have vacated. BACKGROUND: In 1989, the District acquired the property for a flood control improvement project. The District has rented out a portion of the property, which is improved with a single-family residence, since October 1, 2004. The Tenants received notice to vacate the property to facilitate the sale. This settlement is intended to expedite the Tenants move from the property. CONSEQUENCE OF NEGATIVE ACTION: Failure to execute the settlement agreement will impair and prolong, with possible court action, the repossession of the property by the District.
