RA 86- 1 (C.C.P. Section 1245.2757— SUBJECT: Intention to Adopt Resolution of Necessity to Acquire Real Property by Eminent Domain Contra Costa County Redevelopment Agency Project No. 7891-6X5598-86 Pleasant Hill - Walnut Creek Area RESOLUTION OF INTENTION TO ADOPT RESOLUTION OF NECESSITY The Board of Supervisors of Contra Costa County, as the Board of Commis- sioners of the Contra Costa County Redevelopment Agency, RESOLVES THAT: It intends to adopt a Resolution of Necessity for the acquisition by eminent domain of real property in the Pleasant Hill/Walnut Creek area, for redevelopment purposes, a public improvement, which property is more particularly described in Appendix "A" attached hereto. This Board will meet on February 11 , 1986, at 10:30 a.m, in the Board' s Chambers, County Administration Building, 651 Pine Street, Martinez, California , to hear those persons whose property is to be acquired and whose names and addresses appear on the last equalized County assessment roll , and to consider the adoption of the Resolution. The Contra Costa County Real Property Division is DIRECTED to send the following notice to each such person by first-class mail : NOTICE OF INTENTION TO ADOPT RESOLUTION OF NECESSITY The Board of Supervisors of Contra Costa County declares its intention to adopt a Resolution of Necessity for the acquisition by eminent domain of real property in the Pleasant Hill/Walnut Creek area , for redevelopment purposes, a public improvement, which property is more particularly described in Appendix "A"attached hereto. The Board will meet on February 11, 1986, at 10:30 a.m, in the Board' s Chambers at 651 Pine Street, Martinez, California , to consider the adoption of the Resolution. Each person whose property is to be acquired and whose name and address appears on the last equalized County assessment roll has the right to appear at such hearing and be heard on: 1. Whether the public interest and necessity require the project; and 2. Whether the project is planned and located in the manner that will be most compatible with the greatest public good and the least private injury; and 3. Whether the property sought to be acquired is necessary for the project; and 4. Whether the offer of just compensation required by Section 7267.2 of the Government Code has been made to the owner of record. RA 86-1 APPENDIX we PARCEL 1: (HABER - TIrM9ERMAN, APN 148-242-013) Real property in the State of California, County of Contra Costa, unincorporated, described as follows: Portion of the Rancho Las Juntas, described as follows: Commencing at a point on the northerly line of that tract of land described in Parcel One of the deed to the State of California, recorded March 9, 1954 in Book 2281 of Official Records, at Page 388, distant thereon south 89° 55' 58" east, 84.74 feet from the northwesterly corner of said Parcel One; thence south 00 44' 02" west, 64.43 feet; thence along a tangent curve to the left with a radius of 50 feet through an angle of 900 40' an arc length of 79.12 feet; thence south 0° 04' 02" west, 15.00 feet to the northerly line of Geary Read; thence along last said line south 89° 55' 58" east, 15.18 feet to the center line of a 30 foot wide road; thence northerly along said center line, from a tangent which bears north 220 39' 10" east, along a curve to the right with a radius of 1477.59 feet, through an angle of 50 34' 54", an arc length of 143.95 feet to said northerly line of Parcel One; thence along last said line north 890 55' 58" west, 126.09 feet to the point of commencement. V. Ellingsen to George A. Leoni and Mary E. Leoni, his wife, as joint tenants, dated October 23, 1945, recorded November 14, 1945 in Book 852 of Official Records, at Page 385, described as beginning at the northeast corner of said 1.038 acre parcel being the center line of a 30 feet in width road; thence, along the northern line of said 1.038 acre parcel, south 880 53' 30" west, 224.77 feet to the western line of said 1.038 acre parcel, thence, along said western line south 10 06' 30" east, 95 feet; thence north 880 53' 30" east to the eastern line of said 1.038 acre parcel; thence northerly along said eastern line, being the center line of said 30 feet in width road, to the point of beginning.
