HomeMy WebLinkAboutMINUTES - 11122013 - C.09RECOMMENDATION(S): ACCEPT the Grant of the Easement from Grove Sunset, L.P., a California limited partnership, in accordance with Section 5 of the Contra Costa County Flood Control and Water Conservation District Act and FIND the project is a California Environmental Quality Act (CEQA), Class 1c Categorical Exemption, pursuant to Article 19, Section 15061(b)(3) of the CEQA Guidelines. DIRECT the Director of Conservation and Development to file a Notice of Exemption with the County Clerk. AUTHORIZE the Chief Engineer to arrange for payment of a $25 fee to Conservation and Development for processing, and a $50 fee to the County Clerk for filing the Notice of Exemption. DIRECT the Real Estate Division of the Public Works Department to cause said Grant of Easement and a certified copy of this Board Order to be recorded in the office of the County Clerk-Recorder. FISCAL IMPACT: No fiscal impact. The Developer is paying all costs. Project No. EF 1200623 (WL 083A) BACKGROUND: Currently, the Contra Costa County Flood Control and Water Conservation District (District) has a maintenance access road to Marsh Creek at Brentwood Blvd. in the City of Brentwood (City). Currently, Grove Sunset, LP (Developer) is building a new housing project and is required to make frontage improvements to Brentwood Blvd. which will limit the District’s access to their maintenance road. The City is planning to widen Brentwood Blvd. and the bridge over Marsh Creek in the relatively near future and access to the District maintenance road will be permanently cut off. The City is requiring the Developer to grant an access easement across their project, The Grove at Sunset, to the District which will fully restore the District’s access to their maintenance road. These property rights are required for the District to access their flood control facilities on and in Marsh Creek. CONSEQUENCE OF NEGATIVE ACTION: The District will not have sufficient land rights to access their maintenance road at Brentwood Blvd. and Marsh Creek. CHILDREN'S IMPACT STATEMENT: Not applicable.
