HomeMy WebLinkAboutMINUTES - 11052013 - C.42RECOMMENDATION(S): Approve and authorize the Health Services Director, or his designee, to execute, on behalf of the County, Agreement #23-474-1 with the State of California, Office of Administrative Hearings, a government agency, in an amount not to exceed $48,000, to allow the State to conduct hearings for disciplinary actions against Emergency Medical Technicians as required by State regulations for the period from October 1, 2013 through September 30, 2018. FISCAL IMPACT: There is no County General Fund impact. Cost to County is 100% reimbursed from EMT-1 certification Fees and Measure H funds. BACKGROUND: In November 2, 2010, the Board of Supervisors approved an Agreement #23-474 with the State of California, Office of Administrative Hearings, to allow the State to conduct hearings for disciplinary actions against EMT-1 certification as required by State regulations. All disciplinary actions of Emergency Medical Technicians in California are required to be conducted by an Administrative Law Judge. The County only has fifteen (15) days from the appeal request to notify the individual of the OAH hearing. This agreement is necessary to schedule hearings through OAH. Approval of Agreement #23-474-1 will allow the County to continue to utilize the hearing services of the State of California as required by law and regulations through September 30, 2018. CONSEQUENCE OF NEGATIVE ACTION: If this agreement is not approved, the County will not be able to conduct required appeal hearings and would, therefore be unable to enforce EMT-1 certificate denials or disciplinary actions, which would create a potential danger to the public health and safety, and place the County at risk for liability.
