BACKGROUND: The Board of Supervisors has received correspondence from the Law Office of Al Warren Hoslett and Pamela Forbus, representing the Board of Trustees of Reclamation District 2025 (Holland Tract) ["District"]. Mr. Hoslett is the Secretary of the District Board of Trustees. Piepho, District III Supervisor Date:October 22, 2013 Contra Costa County Subject:APPOINTMENT IN LIEU OF ELECTION TO RECLAMATION DISTRICT NO. 2025 (HOLLAND TRACT) BOARD OF TRUSTEES BACKGROUND: (CONT'D) that the Board of Supervisors appoint Mark Landis of 5599 Starfish Place in Discovery Bay to a four year term, in lieu of election, to fill one open seat on the District's Board of Trustees. The District is governed by a three-member board. For contested elections, board members are elected by landowners to staggered four-year terms, with each voter entitled to cast one vote per acre owned within the district. Uncontested vacancies on the governing body are filled by appointment by the Board of Supervisors. The correspondence reflects that a nominating petition was received for the nominee, that the number of nominating petitions received does not exceed the number of offices to be filled; that, pursuant to Water Code Section 50471, notice was published on September 20, 2013 advising that no election would be held for the office of Trustee of the District; and that no petition requesting an election is known to have been filed. CONSEQUENCE OF NEGATIVE ACTION: The proposed nominee to Reclamation District 2025 (Holland Tract) Board of Trustees would not be approved. CHILDREN'S IMPACT STATEMENT: None.
