ADOPT Resolution No. 2013/299, which supersedes Resolution No. 2013/52, regarding compensation and benefits
for the County Administrator, County Elected and Appointed Department Heads, management, Exempt, and
Unrepresented employees to reflect changes as recommended by the Human Resources Director.
FISCAL IMPACT:
The terms and conditions set forth in this action are estimated to cost approximately $66,250 annually, of this amount
approximately $45,400 is pension cost. Future savings will be achieved beginning January 1, 2014 when the 2%
COLA becomes effective for the new PEPRA tiers. The savings from the new pension rates will be significant over
time. There is no fiscal impact from the various administrative changes.
BACKGROUND:
Historically, the wages and benefits granted by the County to its department heads, managers, and unrepresented
employees have paralleled the wages and benefits negotiated by the County with its various labor organizations. The
modifications described below modify the benefits for specified groups of unrepresented employees to be consistent
with those of their companion bargaining groups; reference and define the Public Employees Pension Reform Act
(PEPRA) retirement tier benefits; modify sections to correctly recognize recently created or eliminated classifications;
authorize a specified pay differential for the classification of Executive Assistant II to the County Administrator; and
provide specific benefits for CCCERA employees as directed by the Retirement Board.
The attached Management Resolution has been modified in the following ways:

BACKGROUND: (CONT'D)
Section 6 now provides that for employees who enter the general PEPRA Retirement Tier on and after
January 1, 2014, the pension COLA will not exceed two percent (2%) per year; clarifies that the disability
retirement standard for this PEPRA tier is the same as the standard for Tier III; and specifies that these
provisions do not apply to persons employed as staff to CCCERA.

To implement the Retirement Board’s July 24, 2013 action, Section 16 has been revised to provide that
Contra Costa County Employees Retirement Association (CCCERA) staff hired or promoted into specified
unrepresented positions after April 1, 2011, may elect payment of up to 1/3 of their annual vacation accrual
once every thirteen months, on a prospective basis.

The obsolete classification Director of General Services Exempt (NAA2) has been deleted from section
21.B and 24.
3.
Sections 30.12 and 31.12 have been revised to make three recently created exempt attorney classifications
(2ET1, 2ET2, 2ET3) eligible for State Bar dues and professional development reimbursement and attorney
management administrative leave and longevity pay.
4.
Sections 36.10, 44.10, 52.11, and 53.10 have been revised to reference reciprocal retirement benefits under
the California Public Employees Pension Reform Act (PEPRA) for members of safety retirement tiers.
5.
Sections 46, 49, and 50 have been revised to clarify that the existing classification Assistant
Sheriff-Exempt (6XB2) is eligible for the same P.O.S.T. career incentive allowances, Sheriff law
enforcement longevity differential, and Sheriff uniform allowance provided to the other unrepresented
Sheriff management staff.

Section 49 has been revised to grant prospectively the specified longevity differential on twenty years of
sworn County service to unrepresented sworn Sheriff management classifications.
7.
Sections 5.10, 52.10, and 52.11 have been revised to delete references to Sheriff unrepresented managers’
payment of part of the employer’s share of cost for Safety Tiers A and C. Pursuant to the terms of the
previous Management Benefits Resolution, these payments expired June 29, 2013.
8.
Section 52.12 now states that the pension COLA will not exceed two percent (2%) per year for Sheriff
unrepresented managers in the Safety PEPRA Tier. This is not a change in the existing benefit for this group.
9.
The obsolete classification Chief Deputy Sheriff Exempt (6XB3) has been deleted from section 52.15.10.
Section 53.10 has been revised to provide that for the period of September 1, 2013, through December 31,
2014, employees in miscellaneous safety retirement classifications will pay four and one half percent
(4.5%) of their retirement base to pay part of the employer’s cost of Safety Tier A. For the period of January
1, 2015, through June 29, 2015, these employees will pay two and a quarter percent (2.25%) of their
retirement base towards the employer’s cost for Safety Tier A. On June 30, 2015, these payments will cease.
11.
Section 53.11 now provides that for employees in miscellaneous unrepresented safety classifications who
enter the Safety PEPRA Retirement Tier on and after January 1, 2014, the pension COLA will not exceed
two percent (2%) per year.
12.
Section 55 was added to authorize the specified pay differential for the classification of Executive Assistant
II to the County Administrator.
13.
To implement the Retirement Board’s July 24, 2013, action, Section 56 has been added to grant the
specified pay differentials to specified unrepresented CCCERA staff classifications, commencing August 1,
2013.
14.
CONSEQUENCE OF NEGATIVE ACTION:
If the resolution as described above is not adopted, the County will be out of compliance with the terms of the
Settlement Agreement with the Retirement Board requiring the Board of Supervisors to act within 60 days of the
CCCERA Board's action on certain matters involving unrepresented Retirement Classifications. In addition, if the
action is not taken, unrepresented Safety employees will not be in alignment with their represented cohorts.
