BOYD , Deputy RECOMMENDATION(S): APPROVE the conveyance of an easement to the State of California, Department of Transportation (Caltrans) for freeway purposes over a portion of the Iron Horse Corridor, identified as Parcel Forty-Nine, at Laurel Drive, Town of Danville, pursuant to Government Code Section 25526.6. (Project No. 0678 6G5575) DETERMINE that the conveyance of said easement rights is in the public interest and will not substantially conflict or interfere with Contra Costa County’s (County) use of the property. RECOMMENDATION(S): (CONT'D) AUTHORIZE the Public Works Director, or designee, to execute the Right of Way Contract – State Highway on behalf of the County. AUTHORIZE the Chair, Board of Supervisors, to execute the Easement Deed on behalf of the County in consideration for the payment received in full in the amount of $3,000.00. DIRECT the Real Estate Division of the Public Works Department to cause said Easement Deed and Right of Way Contract – State Highway to be delivered to Caltrans. FISCAL IMPACT: 100% Caltrans. All revenue is for the Iron Horse Corridor. BACKGROUND: The County acquired the real property identified as Parcel Forty-Nine, of the former Southern Pacific Railroad Right of Way, San Ramon Branch, now known as the Iron Horse Corridor (IHC), from the Southern Pacific Transportation Company (SPTC) on December 4, 1986, recorded on December 30, 1986, in Book 13352 at Page 315 Official Records of Contra Costa County. When the County acquired the IHC from SPTC, Caltrans had existing easement rights over a portion of Parcel Forty-Nine for the Interstate 680 Freeway (I-680). Caltrans has expanded I-680 to include an Auxiliary Lane that crosses over an additional portion of Parcel Forty-Nine and now needs to acquire additional easement rights from the County for this expansion. Caltrans has agreed to pay the County the sum of $3,000.00 for the additional easement rights. CONSEQUENCE OF NEGATIVE ACTION: Caltrans will not have the necessary the easement rights for the Auxiliary Lane over the IHC. CHILDREN'S IMPACT STATEMENT: Not applicable.
