SUBJECT: 1986 Legislative Program
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
Adopt the following as the' Board' s 1986 Legislative Program and
authorize the County Administrator to seek authors for and
passage of these measures:
1 . Sponsor legislation to repeal Section 25521 of the Health
and Safety Code as added by AB 2185 (Chapter 1167, Statutes
of 1985) which purports to exempt businesses in Contra Costa
County handling hazardous materials from the inventory
reporting requirements of AB 2185.
2. Sponsor legislation which will allow the County to better
control the solid wastestream in order to adequately carry
out the County' s solid waste planning responsibilities.
3 . Sponsor legislation which will allow regulation of disposal
fees at the dump site through the Solid Waste Management
Plan, including both current and future dump sites.
4 . Support any legislation which may be introduced or sponsor
legislation similar to SB 580 of the 1985 Session which
would have allowed the County to continue reimbursing itself
for the costs of administering the Supplemental Property Tax
Roll, such legislation to be retroactive to July 1, 1985, if
at all possible.
5. Sponsor legislation to add one Superior Court Department
effective January 1, 1987 and two additional Superior Court
Departments which would only become effective upon adoption
of a Resolution by the Board of Supervisors. The creation
of all three positions is to be contingent upon legislative
designation of each additional Judgeship as imposing a
State-mandated local program by requiring a higher level of
service under an existing program.

6. Sponsor a Municipal Court Pay and Staffing bill to the
extent required to conform State law to changes in pay and
staffing made by the Board of Supervisors.
7. Support any legislation which may be introduced, or sponsor
legislation which for purposes of SB 300 (Chapter 1600,
Statutes of 1985) redefines the term "reconstruction" and
allows expenditure of funds for twelve months after date of
receipt.
8 . Support any legislation which may be introduced, or sponsor
legislation which provides for a pass-through of that
portion of a Redevelopment Agency' s tax increment revenue
which would have gone to a fire district if the
Redevelopment Agency had not been established.
9. Sponsor control language in the 1986-87 Budget Act, or any
appropriate "trailer bill" which will require that licensing
fees paid by nursing homes pursuant to Item 4260-001-001 of
the Budget Act and fines paid for citations issued pursuant
to Chapter 2. 4, Division 2 (commencing with Section 1417) of
the Health and Safety Code be credited to the Licensing
Division of the State Department of Health Services in such
a way as to provide incentives to collect such fees and
fines and in order to assist in insuring that increased
revenue is translated into additional inspection and
licensing staff.
10. Sponsor legislation which will allow the County to charge
fees to developers to recover the County' s costs for adopted
General Plan amendments.
11. Concur in actions taken by the County Administrator to
request the Chairman of the Senate Local Government
Committee to include certain non-controversial amendments in
legislation he will carry in 1986 as a Local Government
"clean-up" bill.
12. Continue to aggressively oppose any effort to allocate a
portion of the County' s property tax revenue to other public
jurisdictions within the County without an assured, ongoing
source of replacement revenue.
13 . Continue to oppose any efforts to undermine the Board' s
ability to govern or determine the governing board of
special districts within the County.
14. Direct the County Administrator to monitor efforts to fund
AB 19 (Chapter 1607 , Statutes of 1985) and keep the Board
apprised of developments.
BACKGROUND:
Nearly all of the portions of the recommended 1986 Legislative
Program are restatements of positions the Board has already
indicated it wishes reflected in its 1986 Legislative Program.
This Legislative Program does not contain positions on bills, or
general issues which the Board may wish to simply support or
oppose during the Session except for items 12, 13 , and 14 which
are of particular interest to this County. Other issues and
positions on specific bills will be recommended to the Board as
the Session proceeds. The positions recommended for Board action
at this time include only those issues on which the Board should
actively sponsor legislation. Because of the extremely tight

deadlines for introduction and passage of bills during this
second year of the Session, these items, already represent a very
heavy legislative program. A number of other items have been
recommended by County departments for Board sponsorship. Most
have not been included at this time in order to avoid diluting
staff ' s efforts to achieve passage of the above recommended
items. If other organizations sponsor these other items, the
Board will be asked to support them. Those that are not
introduced in the 1986 Session will be considered for Board
sponsorship at the beginning of the 1987-88 Session when time
permits more thorough consideration by the Legislature. The
County' s contract lobbying firm will be involved in the above
issues where their particular skills can be helpful and to the
extent that their involvement is required.
