ABSTAIN: None .
SUBJECT: Eminent Domain Special Counsel (James M, Berg)
The Redevelopment Agency anticipates filing eminent
domain actions to acquire property within Area 10 of the Pleasant
Hill BART Station Project- Area. The developers of the Project
Area are obligated to pay all costs of property acquisition, including
legal fees. One developer (Wallace-Olson Associates, Inc. ) has
requested that James M. Berg, of Dooley, Anderson, -Berg, Pardini,
Johnson & Ziegler, be employed to represent the Agency in cases
affecting property needed for its development.
NOW, THEREFORE, IT IS HEREBY ORDERED that the Agency engages
James M. Berg to represent- it in cases assigned pursuant to the
approved contract with a term ending January 31, 1987, and as
provided therein.
IT IS FURTHER ORDERED that the Chairperson is authorized to
sign that contract.
