APPROVE and AUTHORIZE the Employment and Human Services Director, or designee, to reinstate the 40/40 work hours for one (1) Child Nutrition Worker III – Project (98G2) position (represented) at salary level QH5 0710 ($2,162 - $2,629), one (1) Child Nutrition Worker II – Project (98G1) position (represented) at salary level QH5 0632 ($2,002 - $2,433) and four (4) Child Nutrition Food Services Transporter – Project (98W2) positions (represented) at salary level QH5 0485 ($1,731 – $2,104) effective August 1, 2013. FISCAL IMPACT: Eliminating the Child Nutrition Worker II and Child Nutrition Worker I positions will result in a saving of $81,000. This savings will be used by the Bureau to offset the loss of State revenue, as well as decreased federal funding due to Re-competition and Sequestration, of approximately $68,000 (annually) from the Child and Adult Care Food Program. BACKGROUND: In June 2012 the California Department of Education informed all programs receiving reimbursement from the Child and Adult Care Food Program (CACFP) for meals provided that the reimbursement rates will be reduced effective July 1st, 2012. The reimbursement received by Community Services Bureau for the 2012-2013 program year has been reduced by $68,000 or approximately $34,000 for six (6) months. In order to continue to meet the regulations without impacting service delivery, Community Services Bureau recommended reduction of the work hours from 40/40 to 32/40 for Child Nutrition employees of the Bureaus’ Child Nutrition Unit. Contra Costa County’s Board of Supervisors approved the action requested by Community Services Bureau (Resolution 2012/524). At the end of April 2013, Community Services Bureau was notified that due to the Head Start Designation Renewal System process (DRS), known as Re-competition, its base Head Start grant will be reduced close to 15% (equal to $3 million) effective July 1st, 2013. Furthermore, effective July 1st, 2013, the Bureau’s Head Start and Early Head Start grants will be impacted by a 5.27% sequester, resulting in an additional budget reduction of approximately $1 million. The allocation of funding resulted in reduction of the Community Services Bureau’s funded enrollment by 276 slots and in shortening of the Part Day, Part Year program options from 39 weeks to 35 weeks of service. The slot reduction, as well as the shortening of the program year for the Part Day, Part Year program (serving 400 children) will result in the preparation of over 300 less meals per day. Therefore, in order to meet its operational needs and the fiscal constraints stemming from the Re-competition, Sequestration and the elimination of the revenue from the Child and Adult Care Food Program, Community Services Bureau needs to modify the staffing and the services of the Child Nutrition Unit. To better align the staffing of the Unit with the needed services and the reduction in budget, Community Services Bureau recommends abolishing one Child Nutrition Worker II (98G1) position and one Child Nutrition Worker I (98W1) position and laying off the incumbents (attachment A-1). Additionally, the Bureau recommends reinstating the work hours from 32/40 to 40/40 for the rest of the employees/positions identified in the Resolution 2012/524 (one Child Nutrition Worker II, one Child Nutrition Worker III and four Child Nutrition Food Services Transporters, see Attachment A-2). Community Services Bureau requests that the above actions take effect the close of the business day July 31, 2013. Furthermore, Community Services Bureau recommends restoring eighty and pay (80) previously-reduced hours to the Child Nutrition Worker II, who will be laid off effective July 31st. Community Services Bureau reached agreement with Public Employees Union, Local One on the recommended actions. CONSEQUENCE OF NEGATIVE ACTION: Failure to abolish positions and lay off employees may result in fiscal deficit for the Community Services Bureau of the Employment and Human Services Department. Furthermore, failure to restore the work hours for certain Child Nutrition Workers III & II and the Child Nutrition Food Services Transporters from 32/40 hours week to 40/40 hours week may result in a grievance or unfair practice charge from Public Employees Union, Local One. CHILDREN'S IMPACT STATEMENT: Community Services Bureau supports all five outcomes established by the Children’s Report Card: (1) Children Ready for and Succeeding in School; (2) Children and Youth Healthy and Preparing for Productive Adulthood; (3) Families that are Economically Self Sufficient; (4) Families that are Safe, Stable and Nurturing; and (5) Communities that are Safe and Provide a High Quality of Life for Children and Families.
