APPROVE and AUTHORIZE the Conservation and Development Director, or designee, to execute a contract
amendment with Crowe Horwath (successor to NewPoint Group), to extend the term from June 30, 2013 through
June 30, 2014 and increase the payment limit by $75,000 to a new payment limit of $225,000 to provide continued
technical assistance services for the County's solid waste and recycling collection franchise agreements.
FISCAL IMPACT:
No impact to the County General Fund. The cost for these services will continue to be paid for with solid waste and
recycling franchise fee revenue.
BACKGROUND:
The Department of Conservation and Development is responsible for administering the County’s four existing solid
waste and recycling collection franchise agreements, which involves detailed rate reviews and other periodic
activities that require technical assistance from persons with specialized expertise.
The County’s existing retainer contract with NewPoint Group expires on June 30, 2013. The Department wishes to
amend this contract, adding an additional year to the previous two year contract, so that Crowe Horwath (successor to
NewPoint Group) can continue to provide consulting services needed to conduct analysis and studies related to the
County's collection franchise agreements. Under this contract, as amended, Crowe Horwath will assume the
obligations of NewPoint Group under the Contract, and will remain on retainer for one additional year, through June
30, 2014, to provide specialized consulting services on an as-needed basis at the direction of the Department. The
services to be provided would include, but not necessarily be limited to rate reviews/studies, efficiency

reviews and feasibility studies. The payment limit of the contract will be increased by $75,000 to enable the
contractor to provide the services during the one-year extension period. The contract will be amended to include
minor revisions to the indemnification provision of the General Conditions (paragraph 18) to apply during the period
from July 1, 2013 through June 30, 2014, but the contractor will continue to be required to indemnify the County. All
remaining terms and conditions will remain in effect through June 30, 2014.
CONSEQUENCE OF NEGATIVE ACTION:
The Department would not have access to the technical expertise needed to thoroughly review and analyze rate
applications and supporting financial documentation in order to determine the appropriate rate changes to be
recommended to the Board. Additionally, the County would not have access to the assistance needed to conduct
technical studies related to collection services and operations (e.g. efficiency) as provided for in the County's
franchise agreements.
