FISCAL IMPACT: 100% CSA T-1 Funds. BACKGROUND: On May 21, 2013, the Board of Supervisors adopted Resolution No. 2013/228, accepting filing of the Fiscal Year 2013/2014 Annual Report for CSA T-1 (Public Transit Services) and fixing June 25, 2013, at 9:30 a.m., in the Board Chambers, as the time and place for a public hearing. The proposed levy of annual public transit service charges benefits all property owners within County Service Area T-1 by providing for public transit services. The public transit services program provides for the operation and maintenance of various public transit related services in the unincorporated area east of the Town of Danville, specifically Alamo Creek/Intervening Properties Development. This action provides for the continuation of existing assessments for public transit services in CSA T-1. This action results in an increase in assessments to parcel owners within CSA T-1 based on the maximum assessment rate allowed for Fiscal Year 2013/14. For Fiscal Year 2013/2014 the allowed maximum rate is $377.62/equivalent dwelling unit. It is proposed to levy charges at the maximum rate for Fiscal Year 2013/2014. CONSEQUENCE OF NEGATIVE ACTION: Fiscal Year 2013/2014 assessments for CSA T-1 would not be levied or collected and public transit services would have to be selectively reduced throughout Alamo Creek/Intervening Properties Development to meet decreased funding levels. ATTACHMENTS Resolution No. 2013/268 Exhibit A ANNUAL REPORT FISCAL YEAR 2013-14 CONTRA COSTA COUNTY SERVICE AREA T-1 (Public Transit) June 25, 2013 Board of Supervisors John Gioia, District 1 Candace Andersen, District 2 Mary Piepho, District 3 Karen Mitchoff, District 4 Federal Glover, District 5 Prepared by Contra Costa County Public Works Department CSA T-1 Public Transit Annual Report Fiscal Year 2013-14 BACKGROUND G:\spdist\Board Orders\2013\6-25-13\T-1\T-1_13-14 AR.doc - 1 - BACKGROUND INFORMATION On June 14, 2005, the Board of Supervisors approved Resolution No. 2005/357 which recommended to the Local Agency Formation Commission of Contra Costa County (LAFCO) the formation of County Service Area (CSA) T-1, Public Transit in the Danville Area. The property located within CSA T-1 receives a special and distinct benefit over and above the general benefits received by the public at-large in the form of extended public transit services. These extended public transit services consist of the implementation of Transportation Demand Management programs as discussed in this report and in the Plan for Providing Services for CSA T-1 which is on file with LAFCO. On October 18, 2005 Resolution 2005/674 stated that the transit services should be supported by a benefit assessment on parcels that receive this special and distinct benefit. On September 14, 2005, LAFCO conducted a public hearing and subsequently approved Resolution 05-15 which formed CSA T-1. On January 17, 2006 the Board of Supervisors conducted a public hearing and subsequently approved Resolution 2006/21 which authorized the annual levy of assessments on the parcels located within CSA T-1 to fund extended public transit services. Each year since Fiscal Year 2006-07 assessments have been levied within CSA T-1. The properties included within CSA T-1 are known as the Alamo Creek/Intervening Properties Development east of the Town of Danville. Together these developments are commonly referred to as the Integrated Project. The Integrated Project constitutes approximately 767 acres located south of Camino Tassajara between Hansen Lane and Finley Road in unincorporated Contra Costa County, California. Wilbur Smith Associates (WSA) completed a Transit Improvements Study of the Integrated Project in March 2005. The study acknowledged that a limited market for transit services and consequently a limited transit service is offered in the study area. The study concluded that a latent demand for transit could be satisfied if a regular commuter service were provided. Given the size of the Integrated Project and the workplace destination and commuting behavior of the adjacent census tracts as outlined by a census-based demographic analysis, a weekday rush-hour commuter service would provide the greatest benefit of transit services under consideration. Specifically, the report recommended that the proposed transit service include the Walnut Creek Bay Area Rapid Transit (BART) station and Bishop Ranch business park as destinations. The desired level of service was based on an analysis of demand performed by WSA. Based on census information and a rider survey performed by BART in 1998, approximately 77 transit trips per day may be expected when the project development is completed. The transit trip total was calculated by WSA as follows:  As presented in the final Environmental Impact Report (EIR) for the Integrated Project, 10,048 daily vehicle trips would be generated at the development; CSA T-1 Public Transit Annual Report Fiscal Year 2013-14 BACKGROUND G:\spdist\Board Orders\2013\6-25-13\T-1\T-1_13-14 AR.doc - 2 -  Assuming an average vehicle occupancy of 1.05 persons per vehicle and a 92.5% vehicle mode share (automobiles constitute 92.5% of transit trips to and from the households), 13,338 person trips would be generated daily by the development;  Based on census information, 5.37% of commuter trips to and from adjacent census tracts used public transit (716 trips);  Approximately 97% of public transit trips used rail (assumed to be exclusive to BART; 694 trips);  Approximately 7% of BART riders at stations nearest to the project (Dublin/Pleasanton, Walnut Creek, Lafayette) used public transit to travel to and from the station (48 trips);  Approximately 4% of transit-based commuter trips used bus service as the primary means of transportation (29 trips); and  Total bus demand (77 trips) includes the sum of transit trips to BART stations (48 trips) and bus trips to work (29 trips). SERVICE IMPLEMENTATION Two transportation studies were previously conducted to understand potential transit usage and travel patterns. The transportation studies are Alamo Creel/Intervening Properties Transit Improvement Study by Wilbur Smith Associates (WSA) in 2005 and Transit Service Survey and Report for CSA T-1 Transit District by DKS Associates in 2010. Based on these studies, the following transit service plan to be implemented in three phase and summarized below: Short – Term (completed in 2012): Community Outreach The short-term strategy focused on community outreach to educate the residents about existing transportation options in Contra Costa County, and to seek their feedback. The community outreach program involved flyer preparation, flyer distribution, and resident feedback. This outreach effort attempted to identify commuter destinations for potential vanpools, an advance of a vanpool/shuttle transit program. Mid-Term (2013/2014): Vanpool/Shuttle Transit Program Based on the feedback provided by the residents, the mid-term strategy would involve a vanpool and/or shuttle service. CSA T-1 staff will initiate the process of selecting a vanpool leasing or a shuttle company to provide transit service and/or coordinate with County Connection to provide the vanpool and/or shuttle service. An initial trial period of three to six month would be evaluated. The evaluation will be based on costs, ridership, administration of the program, and the potential for future program expansion with additional vehicles or public transit bus services. Per the 2005 WSA study, an approximate yearly operating cost of the vanpool services is $70,000. This includes provisions to lease three (3) vehicles, fuel, mechanical services, insurance, communications and a marketing allowance. Long-Term Goal (2014 and beyond): County Connection Service The long-term strategy would involve expanding the vanpool/shuttle service and provide full scale County Connection bus service, if the existing service proves successful and more commuter transit demand is demonstrated. An approximate yearly operating cost of running a full length bus service with County Connection is estimated to be $204,000 per bus. This estimate is based on $100 per hour for 8 hours a day during morning and evening peak commute hours for 255 days a year. CSA T-1 Public Transit Annual Report Fiscal Year 2013-14 BACKGROUND G:\spdist\Board Orders\2013\6-25-13\T-1\T-1_13-14 AR.doc - 3 - The transit service management and legal costs is anticipated to be $15,000. The following is a list of program and services that have been proposed to be considered for funding in Fiscal Year 2013-14 by CSA T-1: 1. Acquisition (through purchase and/or lease) of fleet vehicles. 2. Regularly scheduled and/or unanticipated fleet maintenance. 3. Construction and/or maintenance of bus stop shelters as necessary. 4. Selection of operating subcontractor, either public or private. 5. Maintenance of appropriate insurance coverage for facilities and vehicles. 6. Marketing of transit service. 7. Monitoring of ridership and service performance (e.g., loop time, on-time performance). 8. Recommendations for expansion or contraction of transit service. 9. Preparation of annual CSA budgets. CURRENT ANNUAL ADMINISTRATION As required by the County Service Area Law California Government Code Section 25210.77a(a), the Annual Report includes: (1) a description of each parcel of real property receiving the particular extended service, and (2) the amount of the assessment of each parcel for such year. The Contra Costa County Board of Supervisors will hold a Public Hearing on June 25, 2013, regarding CSA T-1 which will provide an opportunity for any interested person to be heard. At the conclusion of the Public Hearing, the Board may adopt a resolution confirming the annual assessment as originally proposed or as modified. Payment of these annual assessments for each parcel will be made in the same manner and at the same time as payments are made for their annual property taxes. All funds collected through the assessments must be placed in a special fund and can only be used for the purposes stated within this Report. CSA T-1 Public Transit Annual Report Fiscal Year 2013-14 ANNUAL REPORT G:\spdist\Board Orders\2013\6-25-13\T-1\T-1_13-14 AR.doc - 4 - ANNUAL REPORT FOR CONTRA COSTA COUNTY SERVICE AREA T-1 PUBLIC TRANSIT FISCAL YEAR 2013-14 Pursuant to the County Service Area Law (commencing with Section 25210 of the California Government), Proposition 218, and in accordance with Resolution No. 2013/228, accepting the Annual Report, adopted by Contra Costa County Board of Supervisors, May 21, 2013, and in connection with the proceedings for: CONTRA COSTA COUNTY SERVICE AREA T-1 PUBLIC TRANSIT Herein after referred to as the “CSA T-1", I, Warren Lai, the duly appointed ENGINEER OF WORK, submit herewith this "Report" consisting of three (3) parts as follows (as requested in Section 25210.77a (a) of the California Government Code): PART A: METHOD OF ASSESSMENT & ASSESSMENT LIST This part contains a description of each parcel of real property receiving Public Transit services from CSA T-1, the amount of assessment for each parcel for Fiscal Year 2013-14, calculated in conformity with the assessments methodology described herein. PART B: ESTIMATE OF COST This part contains an estimate of the cost of the proposed improvements for Fiscal Year 2013-14, including incidental costs and expenses in connection therewith, is as set forth on the lists thereof, attached hereto. PART C: CSA T-1 DIAGRAM This part incorporates a diagram showing the exterior boundaries and the lines and dimensions of each lot or parcel of land currently with CSA T-1. The lines and dimensions of each lot or parcel are those lines and dimensions shown on the maps of the Contra Costa County Assessor for the year when this Report was prepared. The Assessor's maps and records are incorporated by reference herein and made part of this Report. CSA T-1 Public Transit Annual Report PART A Fiscal Year 2013-14 METHODOLOGY & ASSESSMENT LIST G:\spdist\Board Orders\2013\6-25-13\T-1\T-1_13-14 AR.doc - 5 - PART A METHOD OF ASSESSMENT & ASSESSMENT LIST SPECIAL AND GENERAL BENEFIT Proposition 218 provides that “only special benefits are assessable” and defines a special benefit as a particular and distinct benefit conferred on real property and not a general benefit received by the public at large. The Public Transit services provided within CSA T-1 are deemed a special benefit and only serve the parcels located within the boundaries of the District. ASSESSMENT METHODOLOGY The total operation, maintenance and servicing cost for Public Transit are apportioned in accordance with the methodology that is consistent with standard assessment engineering practices. The method for distributing the costs to each parcel is based on the Equivalent Dwelling Unit (EDU) factor. Since the assessment is levied on the owners of properties as shown on the tax rolls, the final charges must be assigned by Assessor's Parcel Number. If assessments were to be distributed by parcel, not considering land use, this would not be equitable because a single-family parcel would be paying the same as a 50-unit apartment parcel or a large commercial establishment. Therefore, as previously stated, the total assessment costs are distributed to each parcel of land based on the number of EDUs associated with each particular parcel. No commercial or industrial parcels are planned be included in within CSA T-1, therefore an assessment methodology has not been created for those uses. The methodology used to assign EDUs to other land uses in proportion to the benefit they receive relative to the single family residential parcel is shown below. Developed Single Family Residential - The developed single family parcel has been selected as the basic unit for calculation of the benefit assessments. This basic unit shall be called an Equivalent Dwelling Unit (EDU). Parcels designated as developed single family residential uses per the Contra Costa County land use code are assessed one (1.00) EDU. In addition, those parcels that are designated as “vacant” single family residential per the Contra Costa County land use code, but have a building permit issued prior to April 30 are assessed one (1.00) EDU. Developed Multiple Residential – The developed multi-family designation includes parcels designated as apartments, townhomes, and condominiums per the Contra Costa County land use code. Apartments are assessed a factor of 0.723270448 EDU per dwelling unit. For example, a parcel with a 100-unit apartment would be assessed 72.33 EDUs. Townhomes and condominiums are assessed a factor of 0.795597484 EDU per dwelling unit. In addition, those parcels that are designated as “vacant” multi-family residential per the Contra Costa County land use code, but have a building permit issued prior to April 30, are assessed on a per unit basis as shown above. CSA T-1 Public Transit Annual Report PART A Fiscal Year 2013-14 METHODOLOGY & ASSESSMENT LIST G:\spdist\Board Orders\2013\6-25-13\T-1\T-1_13-14 AR.doc - 6 - Exempt Property - Consists of property not classified as Developed Residential Property and includes: commercial, industrial, recreational and institutional property; parking lots, parking garages, roadways, open space and undeveloped property for which a building permit has not been issued prior to April 30. In addition, Senior Housing is classified as exempt. Residents of the Senior Housing will be provided with separate shuttle service not included within the scope of the CSA. ASSESSMENT RATE The maximum annual assessment was established in Fiscal Year 2006-07 as $318.00 per EDU. This maximum assessment may be adjusted annually to reflect a minimum of 2% or the prior year’s change in the Consumer price Index (CPI) for All Urban Consumers for the Bay Area: San Francisco-Oakland-San Jose. The base CPI index to be used for future calculations is February 2006 (207.1). Any change in the assessment rate per EDU, which is the result of the change in the CPI shall not be deemed an increase in the assessment subject to the requirements of Proposition 218. For FY 2013-14 the allowed maximum rate is $377.62/EDU. This rate has been calculated as follows: $318.00/EDU FY 2006-07 + 3.18% increase for FY 2007-08 = $328.12 + 2.77% increase for FY 2008-09 = $337.22 + 2.00% increase for FY 2009-10 = $343.96 + 2.00% increase for FY 2010-11 = $350.84 + 2.00% increase for FY 2011-12 = $357.86 + 3.00% increase for FY 2012-13 = $368.60 + 2.45% increase for FY 2013-14 = $377.62 NEW DEVELOPMENT WITHIN THE CSA If, prior to April 30 of each year, a new building permit is issued for any residential parcel within CSA T-1, it shall be classified as a “Developed” and assessed the ensuing fiscal year. All exempt properties will not be assessed. An assessment list is included on the following pages, which show a listing of those parcels to be assessed for Fiscal Year 2013-14. 15 - PART B ESTIMATE OF COST The FY 2012-13 projected and FY 2013-14 proposed revenues and expenditures are shown in Table 1 on the following page. A special fund has been set up for the collection of revenues and expenditures for CSA T-1. The total cost to provide the Public Transit services can be recovered from the collection of assessments. Incidental expenses including administration, engineering fees, legal fees and all other costs associated with the Public Transit services may be included. When CSA T-1 was formed, a financial analysis was performed to provide the framework for an operating budget for the proposed transit service. This was based on the estimated expenses for continuing operations provided by WSA. In preparation of the budget, several factors were considered including:  Level of Transit Service  Phasing of Service  Equal benefit (and equal assessment level) to residents based on projected resident population In order to establish a reasonable reserve in the early years following formation of the CSA, revenues have been collected since FY 2006-07. For Fiscal Year 2011-12 it is estimated there will be a large surplus of funds. These funds are being set aside into Capital Reserves to purchase vehicles to provide the services to this area when applicable.
