Approve and authorize the Health Services Director, or his designee, to execute, on behalf of the County, Contract
#74–099–12 with John Dawdy, Esq., a self-employed individual, in an amount not to exceed $156,000, to act as the
certification review hearing officer for patients involuntarily confined by County, for the period from July 1, 2013
through June 30, 2015.
FISCAL IMPACT:
This Contract is funded 100% by Mental Health Realignment. (Rate Increase)
BACKGROUND:
Psychiatric patients who have been involuntarily confined have a legal right to a hearing to determine whether they
meet the criteria for continued detention and, in some cases, whether they lack the capacity to refuse or consent to
anti-psychotic medications. The certification review hearing officer conducts these hearings which are mandated by
law.
On June 7, 2011, the Board of Supervisors approved Contract #74–099–11 with John Dawdy, Esq., for the period
from July 1, 2011 through June

BACKGROUND: (CONT'D)
30, 2013, to sit as the certification review hearing officer for patients involuntarily confined by County.
Approval of Contract #74–099–12 will allow the Contractor to continue providing services through June 30, 2015.
CONSEQUENCE OF NEGATIVE ACTION:
If this contract is not approved, there will be no hearing officer and the County will therefore be unable to conduct the
hearings required by law.
