RECEIVE public report of litigation settlement agreements that became final during the period of May 1, 2013
through May 31, 2013, as recommended by County Counsel.

Settlement amounts are listed below.
BACKGROUND:
One agreement to settle pending litigation, as defined in Government Code section 54956.9, became final during the
period of May 1, 2013 through May 31, 2013.
Donald Garabedian v. S.F. Bay Area Rapid Transit Distr., et al. (Alameda Co. Sup. Ct. Case No. RG11575882). The
plaintiff alleged he was subject to discriminatory treatment based on age at the Contra Costa County Law
Enforcement Training Center run by the Sheriff’s Office. As part of a settlement and release agreement, the Board of
Supervisors authorized payment of $100,000 to the plaintiff, inclusive of attorney’s fees and costs. The Board
authorized settlement on April 23, 2013, in closed session, by a 4-1 vote, Supervisor Piepho voting no. The
settlement became final on May 16, 2013. The settlement amount is paid through

This report includes final settlements of litigation matters handled by the Office of the County Counsel. This report
does not include litigation settlements that were reported by the Risk Management Division of the County
Administrator’s Office as a consent item on the Board’s open session agenda.
CONSEQUENCE OF NEGATIVE ACTION:
The report would not be accepted.
