RATIFY the Public Works Director’s execution of a Right of Way Agreement to acquire a temporary construction
easement in real property having Assessor’s Parcel No. 052-030-023 (formerly 052-030-017), for the State Route 4
(E) Widening - Somersville Road to Route 160 Project, Segment 3B, Antioch area. (100% Contra Costa
Transportation Authority Funds) Project No. 4660-6X4168
FISCAL IMPACT:
100% Contra Costa Transportation Authority funds.
BACKGROUND:
As part of the State Route 4 (E) Widening – Somersville Road to Route 160 Project (“Project”) the County is
relocating a City of Antioch water pipeline. The pipeline will be relocated within an easement that the County is
condemning in real property having Assessor’s Parcel No. 052-030-023 (formerly 052-030-017), in the Antioch area
(“Property”). The Property is owned by Donald G. Parachini, et al., (“Property Owners”).
The County is condemning a water pipeline easement in the Property for this relocation. The County obtained
prejudgment possession

BACKGROUND: (CONT'D)
of that easement. However, because the pipeline was located deeper than originally anticipated, the contractor needed
greater access to the Property outside of the water pipeline easement area in order to safely relocate the pipeline.
Due to the urgency of this pipeline relocation work, and to avoid payment of delay damages to the contractor, the
Public Works Director executed a Right of Way Agreement to acquire a temporary construction easement (“TCE”) in
the Property, pursuant to County Ordinance Code Chapter 1108-8. Under the terms of the Agreement: the County
will pay the Property Owners $20,000 (100% CCTA funds) for the TCE; the TCE will remain effective through
September 30, 2013; and the County will indemnify the Property Owners for damages. Ratification of this Right of
Way Agreement is necessary because it requires the County to indemnify the Property Owners.
CONSEQUENCE OF NEGATIVE ACTION:
The project will not have sufficient land rights to allow construction in accordance with the approved plans and
specifications.
